法治与村民自治的契合与互动

【摘要】： 法治与村民自治的推广正在进行中,两者无论是在理论层面,还是在实践层面都存在诸多相同点和不同点,这就决定了两者之间既可能达到理想的契合状态,也可能产生紧张和矛盾。当代中国适逢社会转型期,如何避免两者之间紧张和矛盾的产生或者把冲突所造成的消极影响降至最低限度,促进两者的完美契合,实现两者的良性互动,对于中国的民主宪政建设、社会主义和谐社会建设和社会主义新农村建设都具有十分重要意义。社会主义新农村建设是一项系统工程,依法治国方略和村民自治应该完美地结合起来,互为支撑,依靠法治来保障村民自治,通过村民自治来真正地实现法治,以实现二者的良性互动,最终统一于我国的民主宪政建设。
[Abstract]:The promotion of the rule of law and villagers' autonomy is in progress. There are many similarities and differences in both theory and practice, which determines the ideal state of agreement between the two.Tension and conflict can also arise.Contemporary China coincides with a period of social transformation, how to avoid the tension and contradiction between the two or to minimize the negative impact caused by the conflict, promote the perfect fit between the two, and realize the benign interaction between the two.The construction of socialist harmonious society and new socialist countryside are of great significance to the construction of democratic constitutionalism in China.The construction of a new socialist countryside is a systematic project. The strategy of governing the country according to law and villagers' autonomy should be perfectly combined and supported each other, relying on the rule of law to guarantee villagers' autonomy, and truly realizing the rule of law through villagers' autonomy.In order to achieve the benign interaction between the two, the final unity in China's democratic constitutional construction.
