风险社会背景下的法律变革

【摘要】：当代中国正在进入风险社会,主要表现在贫富差距已达警戒水平,公共安全状况恶化,应对群体事件不力产生政治风险等。为了应对风险社会,法律应作出适当的变革,法律中的传统责任理论也应适度让步于风险社会,要有适度超前的法律变革理念,要掌握好社会发展和风险增加之间的平衡,制定和谐统一的法律制度。
[Abstract]:Contemporary China is entering a risk society, mainly manifested in the gap between the rich and the poor has reached a warning level, the situation of public security has deteriorated, and the failure to deal with group incidents has produced political risks. In order to deal with the risk society, the law should make appropriate changes, the traditional liability theory in the law should also give way to the risk society, there should be a moderately advanced idea of legal reform, and the balance between social development and risk increase should be well grasped. Formulate a harmonious and unified legal system.
