法治思维:创新社会管理的基本思维模式

【摘要】：创新社会管理,提高社会管理科学化水平,是当前理论界和各级政府关注的热点问题之一。如何创新社会管理,从不同的视角可以有不同的认识和相应的措施。针对当前社会管理中的突出问题,创新社会管理的体制、机制、方法、手段,其落脚点是实现国家各项工作的法治化。因而,除了建立、健全各种社会管理机构和社会组织之外,创新社会管理,在各种方法和手段的运用中,法律手段是最基本的手段;创新社会管理的理念思路,法治思维是应当确立的基本思维模式。法治思维是一种国家治理的理念、视角和思路,重视运用法律规则和手段化解社会矛盾,使法治成为一种普遍的行为模式。法治缺失是导致社会矛盾凸现和激化的重要因素,法治思维是社会管理创新的必然要求,法律手段是创新社会管理的最基本手段,具体法治是创新社会管理的基本路径。
[Abstract]:To innovate social management and improve the scientific level of social management is one of the hot issues that the theorists and governments at all levels pay close attention to. How to innovate social management, from different perspectives can have different understanding and corresponding measures. In view of the outstanding problems in the current social management, the aim of innovating the system, mechanism, method and means of social management is to realize the rule of law in every work of the country. Therefore, in addition to the establishment and improvement of various social management institutions and social organizations, innovative social management, in the use of various methods and means, legal means is the most basic means, innovation of social management ideas, Rule of law thinking is the basic mode of thinking that should be established. The thinking of rule by law is a kind of concept, angle of view and train of thought of national governance. We attach importance to the use of legal rules and means to resolve social contradictions, and make the rule of law a universal behavior mode. The lack of rule of law is an important factor leading to the emergence and aggravation of social contradictions. The thinking of rule by law is the inevitable requirement of social management innovation, the legal means is the most basic means of innovating social management, and the concrete rule of law is the basic path of innovating social management.
