构建法律修辞学理论体系刍议

【摘要】：法律的语言表达过程就是法律修辞的过程。法律修辞包括消极的法律修辞和积极的法律修辞两种基本类型。消极的法律修辞存在于法律语言表达的全部过程,是法律修辞的基础,是法律修辞学最重要的、具有普遍意义的研究对象;积极的法律修辞是法律修辞的特殊形式,只存在于特定的法律语言表达情境中。积极法律修辞主要通过辞格和辞趣来实现;消极修辞主要通过辞规与辞风来实现。消极的法律修辞着重于法律语言的准确、平稳的表达,其目的在于方便读者清晰、全面地理解法律表达者的意旨;积极的法律修辞侧重于法律语言的情感表达,其目的在于说服听众接受法律表达者的观点。
[Abstract]:The process of legal expression is the process of legal rhetoric. Legal rhetoric includes negative legal rhetoric and positive legal rhetoric. Passive legal rhetoric exists in the whole process of legal language expression, is the basis of legal rhetoric, is the most important and universal research object of legal rhetoric, and positive legal rhetoric is a special form of legal rhetoric. It only exists in the specific situation of legal language expression. Positive legal rhetoric is mainly realized through rhetoric and rhetoric, and negative rhetoric is mainly realized by rhetoric and rhetoric style. Passive legal rhetoric focuses on the accurate and smooth expression of legal language, which aims at facilitating the reader to understand clearly and comprehensively the intention of the legal expression, while positive legal rhetoric focuses on the emotional expression of the legal language. The aim is to persuade the audience to accept the views of the legal speaker.
