中国地方法制史研究的前世与今生

【摘要】：研究中国地方法制史有其特有的意义,即有利于丰富中国法制史的内涵、发展地方法文化以及为今天的地方法治建设提供借鉴等。前世的研究成果主要可以分为以行政区划、地区和少数民族聚居区来划定的一些成果,涉及的主要内容包括了中国地方的立法、行政执法和司法史等。取得这些成果的原因有多个,主要是研究队伍开始壮大、研究资料开始增多、研究环境开始宽松等。今生的研究还存在一些问题,主要是研究人员较为分散,没有形成合力;研究地域分布不均,研究成果疏密不匀;研究资料没有充分发掘,还有资料未被充分利用;研究方法较为单一,高质量的研究成果不多等。为了推进中国地方法制史的研究,有必要进一步重视研究队伍的扩大和整合、研究资料的收集和研究方法的改进。
[Abstract]:It is of special significance to study the history of local legal system in China, that is, to enrich the connotation of the history of legal system in China, to develop local culture and to provide reference for the construction of local rule of law today. The previous research results can be divided into administrative divisions, regions and areas inhabited by ethnic minorities, including the main content of local legislation, administrative law enforcement and judicial history. There are several reasons for these achievements, mainly because the research team began to grow, the research data began to increase, and the research environment began to be relaxed. There are still some problems in the research of this life, mainly because the researchers are scattered and have not formed a joint force; the research area is uneven and the research results are uneven; the research data are not fully excavated, and the data are not fully utilized; The research method is relatively single, the high quality research result is not many and so on. In order to promote the research of local legal history in China, it is necessary to pay more attention to the expansion and integration of the research team, the collection of research data and the improvement of research methods.
