【摘要】： 中国古代死刑制度经历了两千多年的发展历程,其执行方式经历了由简到繁,从残酷走向人道的发展过程,并且其适用制度与量刑原则对儒家传统文化、法家重刑主义等有着直接而明显的体现,如从罪名上看“不孝不友”罪直接体现了孝观念对死刑制度的渗透,死刑复核制度与复奏制度则深刻反映出儒家传统文化中的慎刑思想,缘坐制度与广泛的法外用刑则是受到了法家重刑主义的影响,秋冬行刑制度的传承是阴阳五行学说的制度表现。中国古代死刑制度及其文化为我们展示了先人的智慧,同时由于文化的积淀与传承,使得古代死刑制度及其文化对中国现行死刑制度仍有着深刻影响。因此对于当中消极的应当摒弃的如重刑主义思想,我们应当坚决抛弃,而对于积极有益的制度与思想,我们应当积极借鉴,用以完善中国今天的死刑制度。
[Abstract]:In ancient China, the death penalty system experienced more than two thousand years of development, its execution went through a process from simplicity to complexity, from cruelty to humanity, and its application system and sentencing principles to the Confucian traditional culture. Legalism has a direct and obvious manifestation, for example, the crime of "unfilial piety and no friends" directly reflects the penetration of the concept of filial piety into the death penalty system. The death penalty review system and the replay system deeply reflect the careful punishment thought in the Confucian traditional culture, while the margin sitting system and the extensive extra-legal punishment are influenced by the legalism. The inheritance of the system of execution in autumn and winter is the system performance of the theory of five elements of yin and yang. The ancient Chinese death penalty system and its culture have shown us the wisdom of our ancestors. At the same time, because of the accumulation and inheritance of culture, the ancient death penalty system and its culture still have a profound impact on the current death penalty system in China. Therefore, we should resolutely abandon the negative ones, such as the severe punishment, and we should learn from the positive and beneficial systems and ideas in order to perfect the death penalty system in China today.
