【摘要】： 立法是一个关系国计民生的重大问题。立法的成败直接关系到广大人民的切身利益,关系到国家发展的千秋大业。民主作为一种政治制度和国家形式,其精神内涵和基本要求就是实行立法民主,即立法只有体现民情和顺应民意才具有合法性基础和正当性前提。立法程序民主是立法民主化的基本要求和具体体现,是立法符合大多数人民意志和利益的重要保障。我国素有“重实体,轻程序”的传统,长期以来对立法程序民主的忽视,给我国社会主义民主法制建设带来了一些消极影响。随着时代的发展和社会的进步,立法程序民主化己经成为民主法制建设中不可逆挡的历史潮流。本文以此为契机,深入思考了立法程序民主这一既有丰富实践又有深厚理论的新问题。本文主体部分共分四章。第一章阐释了立法程序民主的一般理论,并对立法程序民主等相关概念的内涵、外延进行清晰的界定。第二章比较中西方国家立法程序民主制度的主要差异。第三章总结我国立法程序的特点,提出我国在民主立法程序中存在的问题及反思。第四章就我国民主立法程序中存在的问题分析原因,提出完善我国立法程序民主各阶段的合理化建议。本文以此为契机,综合运用法学、政治学和社会学等多学科知识对本课题进行分析论证,拟采用历史分析法对我国立法制度的形成及演变进行系统的梳理,重点分析立法过程中的程序民主问题;用比较分析法分析世界及我国立法程序民主的现状,论证完善我国立法程序民主的问题。本文主体部分共分四章。另外,笔者拟采用比较分析法,比较世界主要国家立法程序,并对其程序民主性作一定的评估,并采取实证分析法,分析世界及我国立法程序民主的现状,论证完善我国现行立法程序民主法律制度的必要性和可行性等。
[Abstract]:Legislation is a major issue related to the national economy and the people's livelihood. The success or failure of the legislation is directly related to the vital interests of the people and the great development of the country. As a political system and state form, democracy has the spiritual connotation and basic requirements for the implementation of legislative democracy, that is, legislation can only reflect the civil situation and conform to the public opinion. The legal basis and the justification premise. The legislative procedure democracy is the basic requirement and concrete embodiment of the legislative democratization. It is an important guarantee for the legislation to conform to the will and interests of the majority of the people. China has always had the tradition of "heavy entity and light procedure", and has long neglected the democracy of the legislative procedure for a long time, which has brought the socialist democratic legal system in our country. With the development of the times and the progress of the society, the democratization of legislative procedure has become an irreversible trend in the construction of democratic legal system. This paper takes this opportunity to think deeply about the new problems of legislative procedure democracy, which has both rich practice and profound theory. The main part of this paper is divided into four chapters.
The first chapter explains the general theory of democracy in legislative procedure, and clearly defines the connotation and denotation of related concepts such as legislative procedure and democracy.
The second chapter compares the main differences between China and Western countries in the democratic system of legislative procedure.
The third chapter summarizes the characteristics of China's legislative procedure, and puts forward the problems and reflection in China's democratic legislative process.
The fourth chapter analyzes the causes of the problems existing in the democratic legislative procedure of China, and puts forward the rationalization proposals for improving the Democratic stage of our legislative procedure.
Taking this opportunity as a turning point, this paper makes a comprehensive analysis and demonstration of the subject by using the multi-disciplinary knowledge of law, politics and sociology. It intends to systematically comb the formation and evolution of the legislative system in China by historical analysis, analyzes the procedural democracy in the legislative process, and analyses the people of the world and the legislative procedure of our country by comparative analysis. The present situation of the Lord demonstrates the perfection of democracy in our legislative procedure. The main body of this article is divided into four chapters.
In addition, the author uses comparative analysis method to compare the legislative procedures of the major countries in the world, make a certain assessment of its procedural democracy, and take an empirical analysis to analyze the status of democracy in the legislative procedure of the world and our country, and demonstrate the necessity and feasibility of perfecting the democratic legal system of the current legislative procedure in our country.
