以欧共体竞争法之视野论相关市场的界定

【摘要】: “相关市场”是竞争法中的一个特定性概念,而相关市场界定更是在竞争法中起着非常重要的作用。在大多数的反垄断案件审理过程中,诸如在企业合并和企业滥用市场支配地位此类案件中,相关市场的界定是反垄断调查机构审查的起点,同时也是下一步——市场份额评估的基石。相关市场的范围直接影响着企业的市场占有量的大小以及该企业实施行为是否违反竞争法的结果。 同我国竞争法在相关市场界定这一领域的初探相比,欧共体竞争法已经形成了一个较为完整的体系。我国的反垄断法有必要结合自身情况,深入学习和研究欧共体竞争法的相关内容,取后者之“精华”,完善在此方面的研究和立法。故本文旨在介绍和研究欧共体竞争法相关市场界定的理论,这些理论对我国相关市场研究方面有一定的借鉴意义,同时,笔者也尝试针对这一理论的司法实践提出一些改良的浅见。 本文除了引言和结论之外,总共分为四个章节。 第一章主要是对欧共体竞争法和我国反垄断法在相关市场立法上的简要介绍;第二章为欧共体相关市场界定的基本理论,该部分分析了相关市场界定的意义及其重要性、判定相关产品市场和相关地理市场的各项因素以及确定相关市场范围的主要方法;第三部分为界定相关市场时需要考虑的其他相关因素,这些因素区别于传统的判定因素而存在一定的复杂性;本文的最后一部分主要是笔者从欧共体竞争法的司法实践中得出的一些启发,对我国在相关市场界定领域给出的一点浅见。
[Abstract]:"relevant market" is a specific concept in competition law, and the definition of relevant market plays a very important role in competition law. In most antitrust cases, such as corporate mergers and abuse of market dominance, the definition of the relevant market is the starting point for review by antitrust investigating bodies. At the same time is also the next step-the cornerstone of market share assessment. The scope of the relevant market directly affects the size of the enterprise's market share and the result of whether the enterprise's enforcement behavior violates the competition law. Compared with our country's competition law, the EC competition law has formed a relatively complete system. It is necessary for our country's anti-monopoly law to study and study the relevant contents of EC competition law, take the "essence" of the latter, and perfect the research and legislation in this respect. Therefore, the purpose of this paper is to introduce and study the theory of the definition of the relevant market of the EC competition law, these theories have certain reference significance to the research of the related market in our country, at the same time, The author also tries to put forward some improved views on the judicial practice of this theory. In addition to the introduction and conclusions, this paper is divided into four chapters. The first chapter is a brief introduction to the relevant market legislation of the EC competition law and the anti-monopoly law of China, the second chapter is the basic theory of the definition of the relevant market of the EC, which analyzes the significance and importance of the definition of the relevant market. Determine the factors of the relevant product market and the relevant geographical market and the main methods of determining the relevant market scope; part three is about other relevant factors to be taken into account when defining the relevant market, These factors are different from the traditional judgment factors and there is some complexity. The last part of this paper is mainly derived from the judicial practice of the EC competition law. To our country in the related market definition domain gives a point of view.
