黎族“刑事”习惯法研究

【摘要】： 古老悠久的黎族“刑事”习惯法是黎族先民们创造的宝贵财富,也是他们留给我们的一种情、理、法有机结合、和谐、高效的传统文化遗产,是那个时代黎族地区最善良、最合理、最完美的制度。黎族“刑事”习惯法有着丰富的内容；既有对侵犯生命、健康的惩罚,也有对侵犯家族、村峒整体利益的制裁,还有对婚姻家庭的维护,原始残酷的死刑、肉刑,灵活实惠的财产刑、耻辱刑等惩罚方法及其地域色彩浓厚的身份刑的适用充分彰显了黎族“刑事”习惯法的地方特色,同时也体现了黎族“刑事”习惯法“家族、村峒整体利益之上”、“连带或责任共担”、“调解为主、强制为辅”、“轻重有别”、“惩治与教化相结合”的原则和“平等但怜老恤幼、血亲复仇、正义免责、土法优先于官法、以赔代罚”的鲜明特点。究其根本,黎族刑事习惯法产生于黎族特有的原始信仰,而其实质则是鬼灵(神)判与人判的结合。法律的价值在于其与社会生活的协调,黎族刑事习惯法与政府“王法”冲突与妥协俱存,依赖与悖逆共生,相辅相成,有机衔接,构成了一幅黎族地区的立体司法图画。古老的黎族刑事习惯法,其平等、民主、公平、自由,重实际、可变通的处事哲学,和谐的理念与追求,具有强大的生命力,可以继续为当今社会建设服务；其野蛮、迷信、残酷、好斗的不良传统,也为我们今天处理黎族地区的纠纷提供了突破口。
[Abstract]:The ancient "criminal" customary law of Li nationality is the precious wealth created by the ancestors of Li nationality, and it is also a kind of feeling, principle, law organic combination, harmony and high efficiency of traditional cultural heritage, which is the kindest of Li nationality area of that era. The most reasonable and perfect system. The "criminal" customary law of the Li nationality has rich contents, including punishment for violating life and health, sanctions for violating the interests of the whole family and village cave, maintenance of marriage and family, primitive cruel death penalty, and corporal punishment. The flexible and affordable punishment of property, humiliating punishment and the application of identity punishment with strong regional color fully demonstrate the local characteristics of the "criminal" customary law of the Li nationality, and at the same time reflect the "criminal" customary law family of the Li nationality. "above the overall interests of the village cave", "joint and several or shared responsibility", "mediation as the main, compulsory as auxiliary", "different in weight", "combination of punishment and enlightenment" and "equal but compassionate to the young, blood relatives revenge, justice exemption," The native law takes precedence over the official law, and pays for punishment. At its root, the criminal customary law of Li nationality originates from the original belief of Li nationality, and its essence is the combination of ghost (God) judgment and human judgment. The value of law lies in the harmony between law and social life, the conflict and compromise between the customary law of Li nationality and the government's "royal law", the symbiosis of dependence and rebellion, mutual supplement and organic connection, constitute a three-dimensional judicial picture of Li nationality area. The ancient Li criminal customary law, with its equality, democracy, fairness, freedom, emphasis on reality, flexible philosophy of handling matters, harmonious ideas and pursuit, has strong vitality and can continue to serve the construction of today's society; its barbarism, superstition, Cruel, aggressive bad tradition, also provides a breakthrough for us to deal with the dispute in Li nationality area today.
