英国法上物权法定原则之考察

【摘要】：无论是从物权种类还是物权内容上进行考究,都可以看出英国法上存在着物权法定原则;英国法之物权法定原则不是一蹴而就的,它的形成经历了一个漫长的时期;普通法时期和衡平法时期已经出现了物权法定的初步框架,而制定法时期物权法定成为财产法立法必须信守的原则之一。了解英国法上之物权法定原则,有利于我们对两大法系物权立法的比较,从而更好地坚守为我国立法所秉持之物权法定原则。
[Abstract]:Whether from the category of real right or the content of real right, it can be seen that there are legal principles of real right in English law, the legal principle of real right of English law is not accomplished overnight, and its formation has experienced a long period. In the common law period and the equity law period, there has been a preliminary frame of the property law, and the property law has become one of the principles which must be adhered to in the property law legislation during the formulation of the law. To understand the legal principle of real right in English law is helpful for us to compare the legislation of real right between the two legal systems, so as to better adhere to the legal principle of real right which is upheld by the legislation of our country.
