中国传统法律文化的特征与价值新论

【摘要】：中国传统法律文化具有连贯性、稳定性、民族性等特质,其主要可分为制度规范上的法律文化和思想意识上的法律文化,前者在近现代的法制变革中基本消亡,而后者却深植于国民的心里,隐身于与法律有关的各项实践中。中国传统法律文化既具有社会综合治理、立法上价值导向、司法上纠纷协调等现代价值,又存在诸多抑制法治发展的不利因素。而中国传统法律文化最好的进路则是通过扬弃与创新,在保留其精髓的同时赋予新的内容,从而实现其自身的现代化。
[Abstract]:The Chinese traditional legal culture has the characteristics of continuity, stability and nationality, which can be divided into legal culture in system norm and legal culture in ideology. The former has basically died out in the legal reform of modern times. The latter is deeply planted Yu Guomin's mind, hidden in the practice of the law. Chinese traditional legal culture not only has modern values such as comprehensive management of society, value orientation of legislation, coordination of disputes in judicature and so on, but also has many unfavorable factors to restrain the development of the rule of law. The best way of Chinese traditional legal culture is to realize its own modernization by sublation and innovation, while preserving its essence and giving new contents.
