《中华民国训政时期约法》制定过程浅析

【摘要】： 《中华民国训政时期约法》是南京国民政府训政时期的根本大法,从法律上正式宣告了训政时期的开始,标志着南京政府正式进入了由军政时期到宪政时期的一个过渡时期。 从大革命之后国民党背叛了革命,国民党的性质已经发生了变化后,为了建立国民党的一党专权,以蒋介石为首的国民政府在北伐结束之后,打着《建国大纲》的幌子,要求召开国会,制定约法,并为制定约法做了大量的准备工作。 在1931年召开了国民会议,并制定了《中华民国训政时期约法》。我们从整个《中华民国训政时期约法》制定过程可以看出,从《训政纲领》到《中华民国训政时期约法》草案的提出,到国民会议代表的产生,再到国民会议讨论“约法”,都是由国民党中央控制的,必然体现国民党的意志,本文主要是通过对《中华民国训政时期约法》制定过程进行分析,揭露了国民党一党专政的本质,从而加深了人们对国民党及其控制的南京国民政府本质了解。
[Abstract]:Law of the Republic of China during the period of political training is the fundamental law of the period of training and administration of the Nanjing National Government. It officially declares the beginning of the period of training and administration and marks the transition period from the period of military administration to the period of constitutionalism. After the Kuomintang betrayed the revolution after the Great Revolution, the nature of the Kuomintang has changed. In order to establish the one-party dictatorship of the Kuomintang, after the Northern Expedition, the Nationalist Government headed by Jiang Jieshi took the guise of "outline of establishing the people's Republic of China". The Congress was called, the treaty law was enacted, and a great deal of preparatory work was done for the treaty law. In 1931, the National Assembly was convened and the Treaty Law of the Republic of China during the period of political training was formulated. We can see from the whole process of formulating the Treaty Law during the period of political training of the Republic of China that from the formulation of the Programme of political training to the proposal of the draft of the Treaty Law during the training period of the Republic of China, to the election of deputies to the National Assembly, and then to the National Assembly to discuss the Treaty Law, Both of them are controlled by the central authorities of the KMT and inevitably reflect the will of the KMT. This article mainly analyzes the formulation process of the "contract Law during the period of the ROC's training in the Government of China" and exposes the essence of the Kuomintang's one-party dictatorship. Thus deepening people's understanding of the Kuomintang and its control of the essence of the Nanjing National Government.
