论清代命案检验错误之处分

【摘要】：清代为了确保检验的正确,设立了严格的处罚制度。随着整个检验制度的发展,这套处罚体系直到嘉庆年间才基本完善。它无论在程序上还是实体上,对官员与仵作、吏役的适用都是不同的,这是"八议"制度的演化与行政处分在清代高度发达相融合的结果。同时,它采用了一种严格的连带处分机制。清代关于检验错误的处分总体设计是精细的,但也存在引发官员集体对抗的负面可能。
[Abstract]:In order to ensure the correctness of the test, the Qing Dynasty established a strict punishment system. With the development of the whole inspection system, the punishment system was not improved until the Jiaqing year. It is a result of the integration of the evolution of the system of "eight discussions" with the highly developed administrative sanction in Qing Dynasty, whether on the procedure or on the entity, the application of official servitude is different from that of the official and the corporeal work, which is the result of the evolution of the "eight discussions" system. At the same time, it adopts a strict mechanism of joint disposition. In Qing Dynasty, the overall design of punishment for testing errors was fine, but there was also a negative possibility of causing collective confrontation among officials.
