交叉质询话语中的权势关系

　　语言在法律领域的重要地位自古就得到了认可。法律是通过词语订立和公布的，语言是法律的载体，所以自法的诞生之日起，就有了法律语言。 近年来，国外越来越多的语言学家为具体的案例作了大量的语言研究工作，并以专家的身份为法律界提供质询或出庭作证。他们的工作涉及的学科多为语音学和笔迹学，如对笔迹和录音材料的辨认和分析。在这些领域，研究方法已发展地相当成熟。而法律话语分析，尤其是法庭话语分析，已成为语言学研究的新热点，其研究方法尚未发展成熟。 法庭话语主要包括控辩双方的开庭综述、法庭询问、结案辩论及反质辩论等。法庭话语分析的主要内容之一是“律师-证人”型询问（examination）话语分析，其中交叉质询（cross-examination）为重中之重。在英美法系中，询问分三种，一种是控辩双方对本方证人的询问，称为直接询问（direct examination）。第二种是控辩双方对他方证人的询问，称为交叉质询。第三种是控辩双方在认为有必要时对被交叉质询过的本方证人再做询问，称为复问（re-examination）。一般说来，询问是以问答式的语言行为进行的。其目的是获取对本方有利的信息。 ...
