文体分析证据在商业诈欺案件中的应用

　　近年来，一些重大商业诈欺案件的曝光极大地动摇了投资者对于公司治理信息披露制度的信心，并最终导致对管理层职业道德的质疑。商业诈欺的危害仅在于损害投资者的利益，而且由于案件的复杂性和涉案人员的刻意误导，给类“白领犯罪”案件的审判造成很多困难。为了体现司法公正，有关人士呼吁除立法堵漏外，应考虑采用其它行之有效的手段来揭露诈欺的真相。语言学分析作为证据鉴定的手段之一受到了重视。本文讨论了文体分析研究应用于揭露证词欺骗的可能性及相应的文体标记。 本文前三章论述了司法语言学中的文体分析及方法，并列举了常用的定性及定量分析标记。第四章介绍了应用文体分析揭示欺骗的各家学说及成果。本文的重点在第五章。以安然能源和寰球电讯两宗震惊世界的商业诈欺案听证会笔录为研究对象，综合四项文体分析研究成果，列出商业诈欺案件疑犯证词中出现频率最高的八个文体标记，通过科学的统计分析发现，其中五个标记的使用与欺骗有关，并且某些标记同时出现的可能性较高，因此可以作为揭示欺骗的标准。进一步的研究表明，这五个标记同时使用时揭示欺骗的准确率远远高于单个标记。论文的总结部分指出该研究结果的局限性和该领域将来的研究方向。
