美国制宪中合理的权力分配：繁荣稳定社会的基础

　　宪法是国家的根本大法,是制定其它一切法律的依据,在整个国家的法律体系中有着至高无上的地位。一个国家的稳定、发展和繁荣离不开一部完善的宪法。 众所周知,美国作为一个建国只有二百多年的年轻国家,现在已经发展成为世界上最发达、最强大的国家。而且,在这二百多年的发展史中,除了内战时期,其国内政局一直比较稳定,这与其有一部较为完善的宪法和实施法制是密不可分的。研究美国宪法对于更好地、更深入地了解这个国家的历史和未来发展具有重大的现实意义。 本文从权力分配的角度,对蕴含在美国宪法中的基本思想和原则进行了剖析。两百多年来,尽管美国宪法在诸多方面已经有了一些变化和发展以适应时代的需要,但这些基本思想和原则一直沿用至今,并在美国的政治、经济和社会生活中发挥着积极的作用。 第一是人民主权的思想,即政府的权力来自于人民,国家主权最终属于人民。第二是三权分立和权力制衡的原则。制宪元勋们把中央政府分为立法、行政、司法三个部门,并通过宪法授予三个部门特定的既相互平衡又相互制约的权力,从而确保了国家权力不会集中到某一部门手中而形成专制。第三个重要的原则是建立联邦制,即在中央政府和州政府之间分配国家权力。美国的联邦制...
