广州城中村改造中的法律援助问题研究

【摘要】：自二十世纪九十年代以来,我国城市化进程开始加快,“城中村”作为城市化发展过程中的必然出现的现象,在我国全面推进城镇化的进程中,“城中村”改造建设暴露出越来越多的问题,严重影响到我国城乡建设的协调发展和国民生活质量的改善,现在已经引起了包括国家、政府、媒体、专家以及学者等在内的社会各界的广泛关注和高度重视。城中村居民作为“城中村”改造过程中的弱势群体,即使他们的合法权益被侵犯了,绝大多数人也无法提供法律途径获得合理的解决。关于本课题的研究,针对现实问题,探讨在城市发展进程中,尤为突出的城中村改造问题,旨在通过法律援助以帮助弱势群体,在城中村改造的得以保护他们的合法权益。本文运用文献研究法、调查法,首先对比分析广州黄埔区、天河区、海珠区三个城中村在法律援助方面的基本情况,并总结相应的特点,然后了解并总结法律援助在城中村建设中的积极作用,再深入分析法律援助在城中村建设中存在的主要问题,最终根据分析提出有针对性的对策。总之,法律援助在城中村建设中有不可或缺的作用,除了在立法、法律监督等方面进行建设外,还需要在有关法律援助的机构建设、资金投入、程序、法律援助的工作人员的素质等方面进行优化和建设。
[Abstract]:Since 1990s, the process of urbanization in our country began to accelerate, "village in city" as an inevitable phenomenon in the process of urbanization, in the overall process of urbanization in China. The reconstruction and construction of "villages in cities" exposed more and more problems, which seriously affected the coordinated development of urban and rural construction in China and the improvement of the quality of life of the people. Now it has caused the country, the government, the media. Experts as well as scholars and other social sectors of the widespread concern and high attention. Urban village residents as a "village in the city" in the process of transformation of vulnerable groups, even if their legitimate rights and interests have been infringed. The vast majority of people are also unable to provide legal access to a reasonable solution. On the research of this topic, in view of the practical problems, this paper probes into the problem of the transformation of villages in cities, which is especially prominent in the process of urban development, in order to help the vulnerable groups through legal aid. This article uses the literature research method, the investigation method, first compares and analyzes the Guangzhou Huangpu District, the Tianhe District, the Haizhu District in the legal aid aspect basic situation. And summarizes the corresponding characteristics, and then understand and summarize the positive role of legal aid in the construction of villages in the city, and then in-depth analysis of the main problems of legal aid in the construction of villages in the city. In short, legal aid plays an indispensable role in the construction of villages in the city, in addition to legislation, legal supervision and other aspects of construction. It is also necessary to optimize and build legal aid institutions, funds, procedures, and the quality of legal aid staff.
