我国监狱突发事件应急管理研究

【摘要】：监狱作为政府的重要组成部门之一,在一定程度上具有行政机关的职能与效能,同时监狱又具有自身的特殊属性。这就决定了监狱机关在承担社会职能上具有任务的多样性与职能的复合性,一方面要承担社会对监狱造成的影响以及由此而引发的危机事件,另一方面也要面对因为监狱自身原因而导致的监狱突发事件,从突发事件本身来看,有些是监狱能够通过自身力量解决的,而更多的需要政府其它部门的协助,甚至在某些特定事件上需要全社会共同参与,长期以来,监狱机关在面临一些危机状态的时候,都习惯于将问题消化于内部,不希望事情扩大影响,在处理一些突发事件的时候,善于现场的管理与控制,而忽视事前的防控与事后的补救,在面对家属、媒体、公众的时候显现的是不自信与不信任,这些都长期以来给监狱的执法形象大打折扣,使得监狱行刑给社会公众留下一些不良的口碑,以至于一旦发生突发事件,公众的注意力更多是关注到警察执法状况,而忽视监狱执法环境、监狱保障状况、监狱狱政设施等重要的客观诱因,这又形成一种恶性循环,使得社会与监狱的距离进一步拉大。本文从监狱管理工作实际出发,对监狱突发事件和应急管理的相关概念进行界定,分析其不同于一般突发事件应急管理的特点；在此基础上梳理了我国监狱突发事件应急管理的现状和存在的问题；最后从处理监狱突发事件应遵守的相关法则,健全突发事件应急管理体系,提高媒体和监狱突发事件应急管理的沟通力度,加强监狱突发事件应急管理与地方的协调配合,加大监狱突发事件应急管理的资金投入等五个方面对完善我国监狱突发事件应急管理提出了意见建议。
[Abstract]:As one of the important components of the government, the prison has the functions and effectiveness of the administrative organs to a certain extent. At the same time, the prison also has its own special attributes, which determines the prison authorities in undertaking social functions with the diversity of tasks and functions of the complex. On the one hand, we should bear the social impact on the prison and the resulting crisis, on the other hand, we should face the prison emergency caused by the prison itself, from the perspective of the emergency itself. Some prisons can be resolved through their own power, and more need the assistance of other government departments, even in certain specific events need the participation of the whole society for a long time. Prison authorities in the face of some crisis state, are accustomed to digest the problem in the internal, do not want to expand the impact of things, in dealing with some emergencies, good at site management and control. Ignoring the prevention and control in advance and the remedy afterwards, in the face of the family, the media, the public is not confident and distrust, these have long been the law enforcement image of the prison greatly reduced. Make the prison execution to the public to leave some bad public reputation, so that once the emergency, the public attention is more concerned about the police law enforcement situation, but ignore the prison law enforcement environment, prison security. Prison facilities and other important objective causes, which form a vicious circle, so that the distance between the society and the prison further widened. This paper defines the concepts of prison emergency and emergency management, and analyzes the characteristics of emergency management which is different from general emergency management. On this basis, it combs the current situation and existing problems of emergency management of prison emergencies in China. Finally, from the handling of prison emergencies should abide by the relevant rules, improve the emergency management system, improve the communication between the media and prison emergency management. This paper puts forward some suggestions on how to improve the emergency management of prison emergencies in China from five aspects, such as strengthening the coordination and coordination between the emergency management of prison emergencies and local authorities, and increasing the investment in the emergency management of prison emergencies.
