舆情民意扩张与刑事司法审判危机应对

【摘要】：传统人治精神及人本观念横行和当下民众"义务警员"倾向①,造就了舆情民意青睐刑事司法审判之不争事实。网络语境下,如何应对舆情民意扩张造成的刑事司法审判危机成为司法机关的当务之急。而要想从此困境突围,必须深挖和解构刑事司法审判视野中的舆情民意,对现行舆情民意能否影响刑事司法审判运行状况之尴尬境况进行实证辨思,并恰当通过舆情民意了解渠道创新配以科学的反馈机制,也方能作好判研刑事司法审判中的舆情民意真相这一工作。
[Abstract]:The traditional spirit of rule by man and the concept of humanism are rampant and the current public "volunteer police officer" tends to 1, which makes public opinion favor the fact that criminal judicial trial is indisputable. In the network context. How to deal with the criminal justice crisis caused by the expansion of public opinion has become an urgent matter for judicial organs. In order to break through the dilemma, we must dig deeply and deconstruct the public opinion in the field of criminal justice. Whether the current public opinion can affect the awkward situation of the criminal justice trial, and properly through the public opinion to understand the channel innovation with scientific feedback mechanism. In order to do a good trial in the criminal justice public opinion truth this work.
