司法救助制度的内涵、价值定位和模式

【摘要】：与司法救助相关的概念和制度有人民法院的当事人司法救助制度、刑事被害人救助制度和国家司法救助制度。概念的分歧直接带来制度认知、构建和实施上的模糊与偏差,不利于司法救助制度的科学合理发展和规范统一运行。立足于一种价值论而非本体论立场的制度理论根基,并基于一种现实必要性而非理论必然性的现实政策选择,应以国家司法救助作为一个统一的概念,在把刑事被害人救助吸纳进来、把人民法院的当事人司法救助排除在外的基础上,整体设计针对刑事和民事侵权案件受害人的损害赔偿救助制度机制,并着手研究制定统一的国家司法救助立法,避免因碎片化的制度制定模式带来立法资源的浪费和规范上的不确定、不统一。
[Abstract]:The concepts and systems related to the administration of justice include the system of judicial assistance for the parties in the people's court, the system for the rescue of criminal victims and the national system of judicial assistance. The differences in concepts directly lead to the ambiguity and deviation in the system cognition, construction and implementation. It is not conducive to the scientific and rational development of the judicial aid system and the standardized and unified operation. It is based on the theoretical foundation of the system based on a position of value rather than ontology, and on the choice of a realistic policy based on a realistic necessity rather than a theoretical inevitability. The concept of national judicial assistance should be taken as a unified concept, on the basis of absorbing the assistance of criminal victims and excluding the judicial assistance of the parties in the people's court, The overall design for criminal and civil tort victims of damage compensation and relief system mechanism, and began to study the development of unified national legislation on judicial assistance, Avoid the waste of legislative resources and the uncertainty and inconsistency due to fragmentation of the system-making mode.
