完善内蒙古法律援助制度的思考

【摘要】：法律援助制度是人类社会法制文明和法律文化发展到一定阶段的必然产物,是现代社会衡量一个国家法治水平和文明进步程度的重要标志。中国法律援助制度的确立是以《法律援助条例》的颁布为标志的。内蒙古自治区自1998年开始法律援助工作以来,取得了长足的进步。然而,与社会实际需求相比,与东部经济发达地区相比,内蒙古自治区法律援助的基本设施建设、经费拨付、人才储备、办案质量等都存在较大的欠缺,法律援助的功能并没有得到充分发挥。当下,如何结合内蒙古自治区的情况最大限度地向社会提供法律援助成为我们面临的时代课题。本文基于实证调查,以内蒙古自治区法律援助实践状况作为研究基础,分析、揭示其存在的问题,并立足内蒙古实际情况,借鉴比较西方国家典型制度,设计一个切实可行的法律援助制度的完善的思路和建议。以期对内蒙古自治区法律援助制度的完善能有所裨益。
[Abstract]:The legal aid system is the inevitable outcome of the legal civilization and legal culture of human society to a certain stage. The establishment of China's legal aid system is marked by the promulgation of the regulations on legal Aid. Since the Inner Mongolia Autonomous region began its legal aid work in 1998, Great progress has been made. However, compared with the actual needs of the society and compared with the economically developed areas in the east, the Inner Mongolia Autonomous region has more deficiencies in the construction of basic facilities, the allocation of funds, the reserve of talents, the quality of handling cases, etc. The function of legal aid has not been brought into full play. At present, how to provide legal aid to the society to the maximum extent combined with the situation in Inner Mongolia Autonomous region has become the subject of our times. Taking the practice of legal aid in Inner Mongolia Autonomous region as the research basis, this paper analyzes and reveals the existing problems, and based on the actual situation of Inner Mongolia, draws lessons from the comparison of typical systems in western countries. To design a feasible legal aid system to improve the train of thought and suggestions, with a view to the Inner Mongolia Autonomous region legal aid system can be helpful to the perfection of the legal aid system.
