论司法改革背景下法官助理制度的构建

【摘要】：随着本次新一轮司法改革的全面推进,作为法官员额制改革重要配套措施的法官助理制度,再次成为关注的热点问题。虽然,我国早在1999年即提出推行法官助理制度的构想,但由于缺乏明确的法律规定与统一的实施规范,致使我国的法官助理制度一直始终停留于各试点法院自行探索阶段,尚未作为一项正式制度真正建立。本文主要是以本次新一轮司法改革为背景,运用文献研究法、功能分析法、比较研究法等方法,对法官助理制度试行过程中存在的问题进行分析,并结合域外国家的成熟制度设计,针对法官助理制度构建中涉及的性质定位、选任模式、配置结构、职责界定、职业保障等方面提出的具体构建设想。本文主要分为以下四个部分:第一部分为概述部分。简要阐述法官助理的基本内涵以及推行法官助理制度的现实意义。第二部分主要为现状及问题分析部分。通过对我国司法面临的现实困境进行分析,提出在新一轮司法改革全面推进之下,构建法官助理制度具有现实紧迫性;并对我国法官助理制度试行历程的梳理,以及对各试点法院采取的做法规定进行收集,从而分析总结出我国法官助理制度在试行过程中存在的问题。第三部分为域外借鉴部分。通过对美国、英国、德国、日本等国家在法官助理的选任、职责界定、职业保障等方面的成熟制度构建进行总结分析。第四部分为制度构建部分。主要从法官助理的职业定位、选任模式、职责界定、配置模式、职业规划等方面提出可操作的制度性意见。
[Abstract]:With the comprehensive promotion of the new round of judicial reform, as the system of judge assistant judge personnel system reform important supporting measures, become a hot issue again. Although, in China as early as in 1999 put forward the concept of implementation of the system of judge assistant, but due to the lack of standardized and unified law clearly, the judge assistant system of our country has remained on the court by the pilot stage of exploration, not as a formal system. The main purpose of this paper is to establish a new round of judicial reform as the background, using the literature research method, function analysis method, comparative research method and other methods, the judges assistant system implementation process in the presence of the problem is analyzed, and combined with the mature system in foreign countries, the involved in the nature of the position, the establishment of judicial assistant system of management, configuration, function definition, protection and other aspects of occupation The specific idea of building surface is proposed. This paper is mainly divided into the following four parts: the first part is the summary part. Practical significance briefly elaborates basic connotation and implementation of judge assistant judge assistant system. Analyzes the current situation and problems of the main part of the second part. Based on the realistic predicament of China's judicial analysis, put forward in advancing a new round of judicial reform under the realistic urgency of establishing the system of judge assistant; and the judges assistant system in China for combing the course and to take on the pilot of the practice of the court shall be collected and analyzed and summed up the judicial assistant system in China exist in the trial process. The third part is the extraterritorial reference part. According to the United States, Britain, Germany, Japan and other countries in the selection of judges assistant responsibilities defined, mature system occupation security and other construction were analyzed. The fourth part is the construction of the system. Mainly from the professional positioning of judge assistant, selection mode, responsibility definition, allocation mode, career planning and other aspects, it puts forward operational institutional views.
