广东省山区基层法院绩效管理问题研究

【摘要】:随着我国经济社会的不断发展,市场主体的多元化,公民群体法律意识的增强,人们对司法的需求与期盼与日俱增。而广东山区基层法院在绩效管理上一方面受珠三角各项指标的影响,但另一方面,影响法院绩效管理的因素与全国中西部很多基层法院有相似之处。在人民法院第三个五年改革之际,对广东山区基层法院的绩效管理问题是一个值得进行研究和探讨的重要课题。 本文在介绍广东山区基层法院绩效管理现状和特点的基础上,分析了影响法院绩效管理的内部因素和外部因素;找出了当前山区基层法院绩效管理上存在的问题主要有:人事上“块块管理”,经费依赖地方,管理体制行政化,法官职业“大众化”,法官承担很多与案件无关的任务以及法院的改革很多是从下位实践而导致法制不统一等;在借鉴两大法系一些国家对法院绩效管理的先进经验的基础上,结合当前广东山区基层法院的实际,运用管理的组织、人力资源、激励、沟通与控制等理论提出了广东山区基层法院绩效管理应有的原则、指导思想以及完善的措施,从而更好地实现经济司法、效率司法与效益司法,更好地指导基层法院和基层法院的法官清醒认识到法院绩效管理与政府绩效管理之间的联系与区别,更深刻认识影响法院绩效的各个因素,坚持法院绩效管理的原则与指导思想,在社会主义法律体系下更好地履行法院和法官的职能,达到为大局服务、为人民司法的高度和谐。
[Abstract]:With the continuous development of our country's economy and society, the diversification of the market subject and the enhancement of the legal consciousness of the citizen group, The demand and expectation for the administration of justice is increasing. On the one hand, the performance management of the grass-roots courts in Guangdong mountain area is influenced by the indicators of the Pearl River Delta, but on the other hand, The factors affecting the performance management of the courts are similar to those of many grass-roots courts in the central and western parts of the country. At the time of the third five-year reform of the people's courts, It is an important subject to study and discuss the performance management of basic courts in mountain areas of Guangdong. On the basis of introducing the present situation and characteristics of the performance management of the grass-roots courts in Guangdong mountainous areas, this paper analyzes the internal and external factors that affect the performance management of the courts. The main problems in the performance management of the grass-roots courts in the mountainous areas are found: "block management" in personnel, the dependence of funds on the localities, and the administration of the management system. The profession of judges is "popular", judges undertake many tasks unrelated to the case and the reform of the court results in the disunity of the legal system from the lower level of practice; on the basis of drawing lessons from the advanced experience of the performance management of the court in some countries of the two major legal systems, Combined with the current situation of the basic courts in the mountainous areas of Guangdong, the author puts forward the principles, guiding ideology and perfect measures of the performance management of the grass-roots courts in the mountainous areas of Guangdong province by applying the theories of organization, human resources, motivation, communication and control. In order to achieve better economic justice, efficient justice and effective administration of justice, and better guide the judges of grass-roots courts and grass-roots courts to realize the relationship and difference between court performance management and government performance management. We should deeply understand the various factors that affect the court performance, adhere to the principles and guiding ideology of court performance management, better perform the functions of courts and judges under the socialist legal system, and serve the overall situation and the people's judicature with a high degree of harmony.
