论利益衡量及其在司法裁判中的运用

【摘要】：利益衡量主张法官在审判案件时首先从案件事实着手分析其所涉及原被告以及社会的各种利益，根据形势变化的需要，对利益关系比较、权衡选择出需要保护的更重要利益，得出初步结论，称之为实质判断。在此基础上再将目光转向法律规定，为实质判断结论赋予理由，即为法律构成。利益衡量理论是日本学者以恢复法解释对社会现实的对应性所探索出的法解释方法论，自日本产生之初便引起了广泛关注，它强调价值判断的运用，为解决法解释领域中所存在的僵化刻板问题开辟了一条新路径，在理论界与实务界产生了极大反响与争鸣。这一理论于上世纪90年代传入我国，并渐成法学理论界与实务界的“热门”话题。全文共分为四个部分。第一部分，介绍利益衡量的基本理论，对其运行模式体现的逻辑思维加以分析，总结其不同于传统三段论模式的推理过程。在实质判断阶段法官对于各种利益的分析、权衡是都必须依靠对案件事实的实质内容进行分析和评价，对各种利益、价值等进行平衡和选择做出价值判断，结论的得出过程实际上就是一个实质推理的运用过程。在理论构成阶段，利益衡量仍然坚持了三段论推理模式，从大小前提推出结论。因此利益衡量将实质推理与形式推理思维综合运用，达到了形式和实质的完美结合。第二部分，介绍利益衡量的具体操作，包括适用范围、衡量的具体方法、衡量的标准及步骤等内容。第三部分，讨论了利益衡量在司法裁判中的运用，从三个方面分析了实践中运用利益衡量的必要性，分析我国古代司法与利益衡量的关系，最后从实质推理角度分析利益衡量在司法裁判中的具体运用。第四部分，探讨司法裁判中适用利益衡量的困境，从法官的思维习惯，，价值判断的客观性，以及利益衡量的滥用三个方面提出了相应的克服方法。
[Abstract]:When judging a case, the judge should first analyze the interests of the original defendant and the various interests of the society. According to the needs of the changes in the situation, the judge should weigh the more important interests that need to be protected by comparing the interest relations.Draw a preliminary conclusion, called substantive judgment.On the basis of this, we turn our eyes to the legal provisions and give reason to the conclusion of substantive judgment, that is, the constitution of law.The theory of interest measurement is the methodology of law interpretation, which is explored by Japanese scholars to explain the correspondence of social reality with the restoration method. It has aroused widespread concern since the beginning of Japan's emergence, and it emphasizes the application of value judgment.It opens a new way to solve the rigid problem in the field of interpretation of law, and has a great reaction and contention in the theoretical and practical circles.This theory was introduced into China in the 1990s and gradually became a hot topic in the field of legal theory and practice.The full text is divided into four parts.The first part introduces the basic theory of interest measurement, analyzes the logical thinking embodied in its operating mode, and summarizes its reasoning process which is different from the traditional syllogism model.In the stage of substantive judgment, the judge must analyze and evaluate all kinds of interests by analyzing and evaluating the facts of the case, balance and choose the interests and values, and make a value judgment.The process of drawing conclusions is actually a process of application of substantive reasoning.In the theoretical composition stage, interest measurement still adheres to the syllogism reasoning model and draws a conclusion from the big and small premises.Therefore, interest measurement combines substantive reasoning and formal reasoning thinking to achieve the perfect combination of form and substance.The second part introduces the specific operation of interest measurement, including the scope of application, measurement methods, measurement standards and steps.In the third part, the author discusses the application of interest measurement in judicial adjudication, analyzes the necessity of using interest measurement in practice from three aspects, and analyzes the relationship between ancient justice and interest measurement in China.Finally, from the angle of substantive reasoning, the paper analyzes the concrete application of interest measurement in judicial adjudication.The fourth part discusses the dilemma of applying interest measurement in the judicial judgment and puts forward the corresponding overcoming methods from three aspects: the judge's thinking habit the objectivity of value judgment and the abuse of interest measurement.
