司法公开:提高司法公信力的前提

【摘要】：完善司法公开制度有利于实现公民的司法知情权、建议权和监督权,使其认识到司法的真实情况,体验到司法公正的客观实际,从而有助于提高司法公信力。中国的司法公开制度建立于清末法制改革以后,新中国成立后这一制度继续被使用,改革开放以后它又有了长足的进步。推进法治建设,进一步完善司法公开制度、提高司法公信力的主要途径是,要进一步更新理念、借鉴世界法制文明的成果、创新制度设计和采取新措施、缩小各法院之间的差距。可以相信,只要大家共同努力,中国能在完善司法公开制度方面走出更为坚实的一步,也会因此而进一步提高司法公信力。
[Abstract]:Perfecting the system of judicial publicity is helpful to realize citizens' right to know, advise and supervise, to make them realize the real situation of judicature, to experience the objective reality of judicial justice, and thus to improve the credibility of judicature. The system of judicial openness in China was established after the legal reform in the late Qing Dynasty, and continued to be used after the founding of New China, and it has made great progress since the reform and opening up. The main ways to promote the construction of the rule of law, to further improve the system of judicial publicity, and to enhance the credibility of the judiciary are to further update their concepts, draw lessons from the achievements of the world's legal civilization, and innovate the design of the system and take new measures. Narrow the gap between the courts. We can believe that as long as we all work together, China can take a more solid step in improving the system of judicial openness, and will further enhance the credibility of the judiciary as a result.
