检察建议的柔性效力及其保障

【摘要】：检察建议尽管是一种职权行为,但对被建议对象而言只具有柔性效力,无论是对检察建议陷入困境的成因分析还是其制度化努力,均应充分观照检察建议的柔性效力这一命题。检察建议的制度化应当在检察权所能辐射的范围内进行,而且这种制度化的结果是对检察机关和检察官的强制和对被建议对象的柔性为体系内容。以现有制度文本为对象,适用范围的重新厘清、以功能为中心构建检察建议的具体运用形式、明确实际制发者在检察建议中的程序地位、增强检察建议的说理性与针对性以及优化考核评估是进一步优化检察建议的方向。
[Abstract]:Although the procuratorial proposal is a kind of authority behavior, it only has the flexible effect to the suggested object. Whether it is the cause analysis of the difficulty of the procuratorial proposal or its institutionalization efforts, the proposition of the flexible effect of the procuratorial proposal should be fully considered. The institutionalization of procuratorial proposals should be carried out within the scope of the procuratorial power, and the result of this institutionalization is the compulsion of procuratorial organs and prosecutors and the flexibility of the recommended objects as the system content. Taking the text of the existing system as the object, the scope of application is clarified again, the concrete application form of the procuratorial proposal is constructed with the function as the center, and the procedural status of the actual issuer in the procuratorial proposal is clarified. Enhancing the rationality and pertinence of procuratorial suggestions and optimizing assessment are the direction of further optimization of procuratorial suggestions.
