【摘要】：法律援助制度是现代法治国家一项不可缺少的法律制度。经过十几年的迅猛发展,我国法律援助制度已经成为中国特色社会主义司法制度的重要组成部分。法律援助,是指在国家设立的法律援助机构的指导和协调下,由律师等法律服务人员为经济困难或特殊案件的当事人给予减、免收费提供法律帮助的一项法律制度。法律援助是政府的责任,同时是律师的义务。社会律师作为中国特色社会主义法律工作者,在我国法律援助工作中发挥着至关重要的作用。 本文主要研究我国社会律师的法律援助工作,并结合具体的统计数据以及其他国家和地区法律援助工作的成功经验,对作为我国法律援助的主力军和中坚力量的广大社会律师的法律援助工作现状进行了详细的总结和阐述,并通过对导致社会律师法律援助工作中存在的主要问题的原因进行综合性地分析,进一步探讨了如何促进社会律师参与法律援助工作的有效途径和方法,从加强经费保障,拓宽筹资渠道;扩大法律援助范围,提高社会律师参与程度;丰富法律援助工作形式;提高法律援助案件服务质量等四个方面进行了相关对策研究,建构出一套较为合理的促进社会律师参与法律援助工作的模式,可操作性强,从而为我国的法律援助事业的健康有序发展提供建议和参考。 论文结构一共分为五章:引言、社会律师在我国法律援助工作中的作用、社会律师法律援助工作中存在的主要问题、促进社会律师参与法律援助工作的对策和结语。其中第三章社会律师法律援助工作中存在的主要问题及原因和第四章促进社会律师参与法律援助工作的对策是本论文的重点。
[Abstract]:Legal aid system is an indispensable legal system in a modern country ruled by law. After more than ten years of rapid development, the legal aid system has become an important part of the socialist judicial system with Chinese characteristics. Legal aid refers to a legal system under the guidance and coordination of the legal aid institutions established by the state, where legal service personnel, such as lawyers, provide legal assistance to the parties in economic difficulties or special cases without charge. Legal aid is the responsibility of the government and the duty of lawyers. As a socialist legal worker with Chinese characteristics, social lawyers play an important role in the legal aid work of our country. This paper mainly studies the legal aid work of our country's social lawyers, and combines the specific statistical data and the successful experience of other countries and regions in the legal aid work. The current situation of the legal aid work of the vast number of social lawyers, who are the main force and the backbone of our country's legal aid, is summarized and elaborated in detail. Through the comprehensive analysis of the causes of the main problems in the legal aid work of social lawyers, this paper further discusses the effective ways and methods to promote the participation of social lawyers in the work of legal aid, so as to strengthen the guarantee of funds. Broadening the channels of financing, expanding the scope of legal aid, improving the participation of social lawyers, enriching the forms of legal aid work, improving the quality of legal aid cases, etc. It is feasible to construct a reasonable mode to promote the participation of social lawyers in the work of legal aid, thus providing suggestions and references for the healthy and orderly development of legal aid in our country. The structure of the thesis is divided into five chapters: introduction, the role of social lawyers in the work of legal aid in China, the main problems in the work of legal aid of social lawyers, and the countermeasures and conclusion to promote the participation of social lawyers in the work of legal aid. In the third chapter, the main problems and reasons in the legal aid work of social lawyers and the countermeasures to promote the participation of social lawyers in the work of legal aid are the emphases of this thesis.
