我国检察机关量刑建议问题研究

【摘要】：量刑是现代法治社会中人们最为关心的一个焦点问题,但由于我国在量刑建议制度方面的缺失,导致法官滥用裁量权没有得到很好的规制,量刑不公成为人们关注的热点问题。量刑建议是行使公诉权权能的一项内容。准确提出量刑建议,可以使刑事诉讼最大限度地实现从程序上保障量刑公正,有利于完善公诉权、扩展辩护权、限制法官的自由裁量权、提高司法效率、提高公诉人的素质。检察机关试行量刑建议的面较广,部分试点单位提出量刑建议较规范,且获得了法院等部门的配合,形成了区域性的指导文件,但应注意的是量刑建议在试行过程中许多问题也暴露出来,如量刑建议趋于形式,审判机关采纳率低；量刑建议缺乏证据支持,说服力不强；量刑标准的认识不同一,没有可参照的量刑标准,量刑建议提出主观随意性比较大等问题,究其原因在于没有完备的制度,缺乏指导性文件,法检二家的量刑标准不统一等,如何实现量刑建议的规范化,不仅是理论上应考虑的问题,更是实务上亟待解决规范的问题,量刑建议规范化涉及内容包括其适用范围、提出原则、实施主体、提出内容、提出方式等,要求我们基于我国刑事诉讼的现状提出可操作性又兼具法理依据的规范化方案,与此同时,量刑规范化不是一项单一的工作,它要求建立与之配套的相关制度,以更好地保证量刑规范化,实现量刑公正。
[Abstract]:Sentencing is one of the most concerned issues in the modern society of rule of law. However, due to the absence of sentencing recommendation system in China, the abuse of discretion by judges has not been well regulated, and unfairness of sentencing has become a hot issue that people pay attention to. Sentencing suggestion is a content of exercising the power of public prosecution. It is possible for criminal proceedings to guarantee sentencing justice to the maximum extent possible, to perfect the right of public prosecution, to expand the right of defense, to limit the discretion of judges, to improve judicial efficiency and to improve the quality of public prosecutors. The scope of the procuratorial organs' trial sentencing recommendations is wider. Some of the pilot units have put forward more standardized sentencing recommendations, and have obtained the cooperation of the courts and other departments, thus forming regional guidance documents. However, we should pay attention to the fact that many problems have also been exposed in the trial process of sentencing recommendations, such as the tendency of sentencing recommendations to form, the low acceptance rate of the judicial organs, the lack of evidence to support sentencing recommendations, the lack of persuasive force, and the different understanding of sentencing standards. There are no standards for sentencing that can be referenced, and sentencing suggestions raise such problems as the relatively large subjective arbitrariness. The reasons lie in the lack of a complete system, the lack of guidance documents, the disunity of the sentencing standards of the law and procurators, and so on. How to realize the standardization of sentencing recommendations is not only a theoretical issue to be considered, but also a practical problem to be resolved urgently. The standardization of sentencing recommendations involves the scope of its application, the principles, the implementation of the main body, and the content. It requires us, based on the present situation of our country's criminal procedure, to put forward an operational and legal-based standardization scheme. At the same time, the standardization of sentencing is not a single work, it requires the establishment of related systems. In order to better ensure the standardization of sentencing, the realization of sentencing justice.
