【摘要】：正党的十八大报告提出:"进一步深化司法体制改革,确保审判机关、检察机关依法独立公正行使审判权、检察权。"这一表述虽然原则但却高度概括,意蕴深刻。一、从执政党对司法改革表述及其实践的渐进性看其意蕴1.党的十五大首次提出"推进司法改革"。1997年,党的十五大提出依法治国,建设社会主义法治国家的历史任务,与此相适应,首次提出"推进司法改革,从制度上保证司法机关依法独立公正地行使审判权和检察权,建立冤案、错案责任追究制度"。为贯彻落实推进司法改革的任务,1999年,最高人民法院、最高人民检察院分别出台了《人民法院五年改革纲
