罪犯个别化改造人格重塑模式研究

【摘要】：随着“首要标准”的提出和监狱工作重心的战略转移。把罪犯改造成为自食其力的守法公民和社会主义建设的有用之材,成为是监狱工作的中心任务。2005年以来,全国许多大型、较大型监狱试行对罪犯进行个别化改造,经过6年的创新发展,取得了显著的成绩。笔者通过调查研究认为,罪犯个别化改造独特的研究方法、规范的矫治报告、详实的项目案例等等这些都是耕耘在管教工作前沿的优秀警官们用辛勤的汗水换来的。但毋容置疑,任何方法和模式都不可能是完美无缺的,现有罪犯个别化改造也避免不了某些局限与不足。随着国家法制建设与监狱工作迅速发展,加之近几年个别化改造基础理论研究方面的欠缺,这就使其在实践改造中的滞后性愈加显现。鉴于此,本文将从一种全新的哲学视角出发,提出一种以重塑人格为核心的新的个别化改造模式,以其达到对现有个别化改造模式的融合与超越。对于全国很多监狱实行的罪犯个别化改造模式,本文在总结既往的经验的基础上,引入人格心理学相关研究成果,借鉴犯因性差异理论和人格改造理论的内容,并结合监区一线工作的实践,提出一种以重塑人格为核心的新的个别化改造模式,希望弥补现有个别化改造理论的不足,以其达到对现有个别化改造模式的融合与超越的。人格重塑模式是监狱罪犯个性化改造的一种新模式,它是基于人格研究相关理论发展而来的,并结合个案矫治技术应用于监管改造实践。其目的在于通过对罪犯人格的重塑使罪犯充分认识到自身能力,发挥潜能,完善自我人格;增进其适应环境和解决问题的能力,从而达到顺利回归社会和预防重新犯罪的目的。
[Abstract]:Along with the "primary standard" proposed and the prison work center of gravity strategic shift. Transforming criminals into self-supporting law-abiding citizens and useful materials for socialist construction is the central task of prison work. Since 2005, many large and relatively large prisons throughout the country have experimented with individual reform of criminals. After 6 years of innovation and development, remarkable achievements have been made. Through investigation and research, the author thinks that the unique research methods, standardized correction reports, detailed project cases and so on are all obtained by the excellent police officers who have worked hard at the forefront of correctional work. However, there is no doubt that any method and model can not be perfect, the existing individual rehabilitation of criminals can not avoid some limitations and shortcomings. With the rapid development of the national legal system and prison work, coupled with the lack of basic theoretical research on individualized transformation in recent years, this makes its lag in practical reform more apparent. In view of this, this paper will put forward a new individualized transformation model with the core of remoulding personality from a new philosophical angle of view, so as to achieve the fusion and transcendence of the existing individualized transformation mode. On the basis of summing up the past experience, this paper introduces the relevant research results of personality psychology, and draws lessons from the theory of the difference of criminal cause and the theory of personality reform. Combined with the practice of the first line work in the prison area, a new individualized transformation model with the core of remoulding personality is put forward, which hopes to make up for the deficiency of the existing individualized transformation theory and to achieve the fusion and transcendence of the existing individualized transformation mode. Personality remoulding model is a new model of prison criminals' individualized reform. It is based on the relevant theory of personality research and applied to the practice of supervision reform combined with the case correction technology. Its purpose is to make criminals fully realize their own ability, exert their potential, improve their self-personality, and improve their ability to adapt to the environment and solve problems, so as to achieve the purpose of returning to society smoothly and preventing reoffending by remolding the criminal's personality.
