我国司法权监督与制约问题研究(上)

【摘要】:权力必须受到监督与制约是任何一个奉行民主政治的国家权力运作的基本规则,不受监督与制约的权力必然导致腐败。司法权属于权力,具有权力的属性特征,所以司法权也必须受到监督与制约。只有将司法权力置于一个有效的机制下,才能正常合理的运作,才不至于使掌握并行使司法权力的人滥用权力。绝对的权力必然导致绝对的腐败。因此,对司法权力必须进行监督与制约,凡是不受监督与制约的权力,必定会被滥用而导致司法的专横与腐败。历史的经验值得注意,虽然我们的司法改革取得了一定的成绩,但是由于对司法权力的监督与制约无力,司法腐败现象不能得到有效的遏制。由于对司法权的监督与制约不力,司法腐败现象才会如此猖獗,司法权滥用的现象才会被掌权者用的那样的冠冕堂皇。总之,对司法权力的监督与制约势在必行,社会愈发展愈现代化,法治化,这种要求愈强烈。而如何更有效地对司法权进行监督与制约,尤其是我国目前处于转型时期,所以如何使司法权公平、公正的运行,达到减少腐败和遏制腐败的目的,将需要我们以全新的视角,更加深层次地来研究如何对司法权进行监督与制约。 本文第一章阐述了司法权监督与制约的相关理论。首先,笔者结合我国国情及司法实践,同时为了本课题研究的需要将司法权界定为“三权说”即审判权、检察权和侦查权,并对司法权的权力属性进行了分析;其次,通过对司法权监督与制约的内涵及监督与制约不力的后果进行分析,指出司法权监督与制约的必要性;最后,笔者对司法权监督与制约的理论基础和国外的先进经验进行了归纳整理,为我国司法权监督与制约机制的改革和完善提供了理论指导。本文第二章对我国司法权监督与制约的现状及存在问题进行了分析,我国的司法腐败有愈演愈烈之势,司法权的运行缺乏必要、合理、有效的监督与制约。目前党和政府的权力过于扩张;人大监督体制流于形式;私权利自身尚不能形成一股有效的监督与制约的力量;“程序正义”的观念有待普及,法律程序制定粗陋,无法形成对司法权的有效制约;新闻法制定滞后,媒体监督依据不足;司法职业群体未完全形成,司法官员职业素养不高,无法通过自律方式保证司法权的正当运行。本文第三章为保证司法权监督与制约的科学性与有效性,笔者大胆提出构建“我国特色之五大司法权监督与制约体系”,即权力监督与制约体系、权利监督与制约体系、程序监督与制约体系、舆论监督与制约体系和道德监督与制约体系。在五大监督与制约体系下,司法权将受到全面、合理、高效、科学的监督与制约,使司法权能公开、公平、公正的运行,从而实现司法正义。
[Abstract]:The power must be supervised and restricted is the basic rule of the power operation of any country that pursues democratic politics, and the power not subject to supervision and restriction will inevitably lead to corruption. The judicial power belongs to the power, has the power attribute characteristic, therefore the judicial power must also be supervised and restricted. Only by putting the judicial power under an effective mechanism, can the judicial power be operated normally and reasonably, and the people who hold and exercise the judicial power will not abuse the power. Absolute power inevitably leads to absolute corruption. Therefore, the judicial power must be supervised and restricted, and the power which is not subject to supervision and restriction will be abused, which will lead to judicial arbitrariness and corruption. The historical experience is worth noting, although our judicial reform has made certain achievements, but because of the weak supervision and restriction of judicial power, judicial corruption can not be effectively contained. Because of the weak supervision and restriction of judicial power, the phenomenon of judicial corruption will be so rampant, and the abuse of judicial power will be used by those in power. In a word, it is imperative to supervise and restrict the judicial power. And how to supervise and restrict the judicial power more effectively, especially when our country is in the transition period, so how to make the judicial power fair and just, to achieve the purpose of reducing corruption and curbing corruption, we need a new angle of view. A deeper study of how to supervise and restrict judicial power. The first chapter of this article elaborated the judicial power supervision and the restriction correlation theory. First of all, the author defines judicial power as "three powers theory", that is, judicial power, procuratorial power and investigation power, and analyzes the power attribute of judicial power for the sake of the need of the research of this subject, combining with our country's national conditions and judicial practice. By analyzing the connotation of supervision and restriction of judicial power and the consequences of weak supervision and restriction, this paper points out the necessity of supervision and restriction of judicial power. The author summarizes the theoretical basis of supervision and restriction of judicial power and the advanced experience of foreign countries, which provides theoretical guidance for the reform and improvement of the supervision and restriction mechanism of judicial power in China. The second chapter analyzes the current situation and existing problems of the supervision and restriction of judicial power in our country. The judicial corruption in our country is becoming more and more serious, and the operation of judicial power is lack of necessary, reasonable and effective supervision and restriction. At present, the power of the Party and the government is too expanded; the supervision system of the people's Congress is a mere formality; the private rights themselves cannot form an effective force of supervision and restriction; the concept of "procedural justice" needs to be popularized, and the legal procedures are crude, Unable to form an effective restriction on judicial power; press law lags behind, media supervision basis is insufficient; judicial professional groups are not fully formed, judicial officials professional literacy is not high, can not ensure the proper operation of judicial power through self-discipline. In the third chapter, in order to ensure the scientific and effective supervision and restriction of judicial power, the author boldly proposes to construct the "five judicial supervision and restriction systems with Chinese characteristics", that is, the power supervision and restriction system, the right supervision and restriction system. Procedural supervision and restriction system, public opinion supervision and restriction system and moral supervision and restriction system. Under the five systems of supervision and restriction, the judicial power will be subject to comprehensive, reasonable, efficient and scientific supervision and restriction, which will enable the judicial power to run openly, fairly and justly, thus realizing judicial justice.
