浅谈职务犯罪侦查工作如何应对刑诉法修改的挑战

【摘要】：新刑诉法于2012年3月14日通过审议,于2013年1月1日实施。刑诉法修改完善了辩护律师的会见权、阅卷权、调查取证权等,确立了非法证据排除规则、不得强迫自证其罪、同步录音录像制度、检察机关技术侦查权等。新形势下自侦部门在职务犯罪侦查中要更新执法理念,开展透明侦查、依法取证,摒弃口供至上观念;增强侦查队伍实战能力,提升初查质量,全面收集固定证据,提高"镜头下"办案能力;健全工作机制,包括立案侦查启动机制、信息引导侦查机制。
[Abstract]:The new criminal procedure law was adopted in March 14, 2012 and was carried out in January 1, 2013. The amendment of the criminal procedure law has improved the right of meeting the defense lawyers, the right of reading papers, the right to investigate and obtain evidence, and so on. It established the exclusionary rule of illegal evidence, not to force self proof, synchronize the system of recording and video recording, and the procuratorial machine's right to investigate the technical investigation. In the crime investigation, we should renew the concept of law enforcement, carry out transparent investigation, obtain evidence in accordance with law, abandon the first concept of oral confession, strengthen the actual combat ability of the investigation team, improve the quality of the preliminary investigation, collect the fixed evidence comprehensively, improve the ability to run a case under the lens, and improve the working mechanism, including the starting mechanism of the case investigation, and the information guidance investigation mechanism.
