广东省四会监狱减刑工作的内部监督研究

【摘要】：减刑作为监狱日常执法的一项重要工作,对促进罪犯的改造、维护监狱的稳定以及体现国家司法的宽严相济政策都起着举足轻重的作用。但目前我国监狱减刑监督存在法律制度规定不完善、监督手段不健全、现有监狱监督机制没有发挥作用、社会和新闻舆论对监狱监督缺乏法律保障等问题,以致监狱在减刑工作上出现像“张海案”之类的腐败案件,严重影响监狱和国家执法机关在群众中的形象。目前,多数学者都从外部监督的角度,研究监狱减刑工作的监督机制,但由于监狱是特殊的司法机关,其封闭性决定了外部力量难以实现真正有效的监督,尽管内部监督机制已被有些学者否定,但从监狱内部的机构和机制调整角度出发,构建有效的层级监督机构和交叉监督机制,是实现监狱减刑工作监督的突破口,也是解决监狱减刑工作监督难的重要途径。本文选择从内部监督的角度出发,通过选取广东省四会监狱作为个案进行研究,应用文献分析法、访谈法、比较分析法以及个案研究法等公共管理学研究方法,从制度依据、主体、对象、程序和机制等方面,分析广东省四会监狱减刑工作内部监督的现状,然后,采用案例分析以及比较分析等方法,客观剖析广东省四会监狱减刑工作内部监督存在的问题,从而分析得出法定监督条件和标准的缺失,内部监督程序的不完善,办理减刑案件的自由裁量权内部监督失控以及警察对罪犯考核的内部监督不力等造成广东省四会监狱减刑工作内部监督问题的成因。最后,本文尝试在个案研究的基础上,探索监狱减刑内部监督的新机制,提出法律控制、程序控制、机构整合、权利控制以及主体控制五个方面的对策建议,以其解决当前广东省四会监狱减刑工作内部监督面临的困境,为监狱减刑工作构建长久有效的内部监督机制。
[Abstract]:As an important part of the daily law enforcement in prisons, commutation plays an important role in promoting the reform of criminals, maintaining the stability of prisons and embodying the policy of combining justice with leniency and severity. However, at present, there are some problems in the supervision of prison commutation in our country, such as the imperfection of the legal system and regulations, the imperfect means of supervision, the failure of the existing prison supervision mechanism, the lack of legal guarantee for prison supervision by the society and the public opinion, etc. As a result, there are corruption cases such as the Zhang Hai case in the prison, which seriously affects the image of the prison and the state law enforcement agencies among the masses. At present, most scholars study the supervision mechanism of prison commutation from the angle of external supervision. However, because the prison is a special judicial organ, its closeness determines that it is difficult for the outside forces to realize the real and effective supervision. Although the internal supervision mechanism has been denied by some scholars, it is a breakthrough to realize the supervision of commutation of prison sentences by constructing an effective hierarchical supervision mechanism and cross-supervision mechanism from the point of view of the adjustment of the prison internal institutions and mechanisms. It is also an important way to solve the problem of prison commutation. From the angle of internal supervision, this paper chooses the four associations prisons of Guangdong Province as a case study, applies literature analysis method, interview method, comparative analysis method and case study method and so on, from the system basis. From the aspects of subject, object, procedure and mechanism, this paper analyzes the present situation of the internal supervision of the prison commutation work of the four associations in Guangdong Province, and then adopts the methods of case analysis and comparative analysis. This paper analyzes objectively the problems existing in the internal supervision of the commutation of prison sentences in the four sessions of Guangdong Province, and concludes that the lack of legal supervision conditions and standards, the imperfections of the internal supervision procedures, The causes of the internal supervision of the prison commutation work in Guangdong Province are caused by the uncontrolled internal supervision of the discretion to deal with the commutation cases and the inadequate internal supervision of the police on the assessment of the criminals. Finally, on the basis of the case study, this paper attempts to explore the new mechanism of prison sentence commutation internal supervision, put forward five aspects of legal control, procedural control, institutional integration, right control and subject control. In order to solve the difficulties faced by the internal supervision of prison commutation of the four sessions in Guangdong Province, this paper sets up a long-term and effective internal supervision mechanism for prison commutation.
