司法公正视野下的司法诚信研究

【摘要】：司法诚信是促进司法公正的重要因素,目前我国司法诚信的研究尚付阙如,笔者认为,司法公正语境下的司法诚信是道德与法治标准的统一、实体与程序公正的统一、社会与司法效果的统一。司法诚信具有正义理念、源头治理、责任司法、提高司法效率之价值。应从确立司法诚信原则、明确司法诚信范畴、设立司法诚信运行模式、严格司法失信法律责任四个方面形成诚信促公正的司法机制。
[Abstract]:Judicial honesty is an important factor to promote judicial justice. At present, there is no research on judicial honesty in our country. The author believes that judicial honesty in the context of judicial justice is the unity of moral and legal standards, and the unity of entity and procedural justice. The unity of social and judicial effects. Judicial honesty has the value of justice idea, source management, responsibility judicature and judicial efficiency. The judicial mechanism of promoting justice should be formed from four aspects: establishing the principle of judicial honesty, defining the category of judicial honesty, establishing the operation mode of judicial honesty, and strictly enforcing the legal responsibility of judicial dishonesty.
