检察辅助人员辅助办案机制检视

【摘要】：正检察人员分类管理制度改革和司法责任制改革,均应以检察官为中心并无异议,但并不意味着检察辅助人员相关制度构建与理论研究处于次要地位。检察辅助人员在我国检察视域中是个新生事物,在现有法律规范中没有体现,改革前也缺乏实践经验。检察辅助人员如何配置、具有哪些职权、如何承担责任,都是迫切需要解决的问题。这些相关问题厘清之后,才能构建科学合理的辅助办案机制,检察改革的目标才能真正实现。一、检察辅助人员的构成与定位
[Abstract]:There is no objection to the reform of classified management system and judicial responsibility system of procuratorial personnel, but it does not mean that the construction of relevant system of procuratorial assistant personnel and the theoretical research are in a secondary position. The procuratorial assistant personnel is a new thing in the procuratorial field of our country, which is not reflected in the existing laws and regulations, and lacks the practical experience before the reform. How to allocate procuratorial assistant personnel, what functions and powers, how to assume responsibility, are urgent problems to be solved. Only after these related problems have been clarified can we construct a scientific and reasonable auxiliary case handling mechanism and realize the goal of procuratorial reform.
