【摘要】：20世纪早期,社区矫正在欧美国家兴起,经过几十年的发展,社区矫正制度被公认为是一种人道、经济、文明、有效的行刑方式。许多国家适用社区矫正的人数大大超过监禁人数,美国、英国、加拿大等西方发达国家的社区矫正已经有了完善的法律制度和健全的工作机制。社区矫正在我国还是一个新生事物,自2003年7月启动全国性社区矫正试点工作以来,目前社区矫正试点范围已扩展到25个省(区、市),从试点工作来看,我们探索总结了很多成功经验和有效做法,取得了一定的法律效果和社会效果,但我国社区矫正工作仍处于本土化过程的初始阶段,客观上存在着许多亟待解决的困难和问题,如社区矫正刑罚理念支撑薄弱、社区矫正本土化法律突破与创新不足、社区矫正本土化的经费保障机制不完善、社区矫正机制的独立性不强、社区资源和社会力量的作用未能充分发挥等。本文着力对社区矫正本土化的内涵、国内诉求、价值理念认同、现实状况和本土化的推进策略和前瞻等方面进行理论和实践上的探讨,旨在为本土化工作理清思路、排除障碍,进而为推进我国社区矫正本土化进程与改革和完善我国的刑事执行体系建言献策。全文共分为四个部分: 第一部分对社区矫正的起源发展、概念与性质、理论基础以及社区矫正本土化的必要性进行了分析论证,将社区矫正的性质界定为刑罚执行活动,为其进一步发展提供空间。第二部分对我国社区矫正制度的试点状况进行了介绍与评析,着重介绍了我国社区矫正试点工作开展以来所取得的成绩与存在的问题。第三部分通过对社区矫正制度在国外的发展状况的介绍,分析国外社区矫正制度对我国的借鉴意义。第四部分对我国社区矫正本土化的路径与方案提出建议,在尊重中国社会现实的基础上,确立社区矫正本土化的理念与原则,完善相关法律配套制度,建立专业的人员队伍等。
[Abstract]:In the early 20th century, community correction rose in Europe and America. After decades of development, community correction system is recognized as a humane, economic, civilized and effective execution. In many countries, the number of people applying community correction is much higher than the number of incarceration. The United States, Britain, Canada and other western developed countries have a sound legal system and a sound working mechanism. Community correction is still a new thing in our country. Since the national community correction pilot work was launched in July 2003, the pilot range of community correction has been extended to 25 provinces (districts, municipalities). From the point of view of the pilot work, We have explored and summed up many successful experiences and effective practices, and obtained certain legal and social effects. However, the work of community correction in our country is still in the initial stage of the localization process, and there are many difficulties and problems to be solved objectively. For example, the concept of community correction penalty is weak, the legal breakthrough and innovation of community correction is insufficient, the funding guarantee mechanism of community correction is not perfect, and the independence of community correction mechanism is not strong. The role of community resources and social forces has not been brought into full play. This paper focuses on the theoretical and practical discussion on the connotation, domestic demand, value concept identity, reality situation and the strategy and prospect of the localization of community correction, in order to clear the way of thinking and remove the obstacles for the localization work. Further, suggestions are put forward to promote the localization of community correction and to reform and perfect the criminal execution system of our country. The full text is divided into four parts: The first part analyzes the origin, concept and nature of community correction, its theoretical basis and the necessity of the localization of community correction, defines the nature of community correction as the execution of punishment, and provides space for its further development. The second part introduces and evaluates the status of the community correction system in our country, focusing on the achievements and existing problems of the community correction pilot work in our country since it was carried out. The third part introduces the development of community correction system in foreign countries, and analyzes the reference significance of foreign community correction system to our country. The fourth part puts forward suggestions on the path and scheme of the localization of community correction in our country. On the basis of respecting the reality of Chinese society, it establishes the concept and principle of the localization of community correction, consummates the supporting system of relevant laws, and establishes the professional personnel team, etc.
