罪犯健康权保障问题探析

【摘要】：健康权作为罪犯的应有权利和法定权利,维护罪犯的合法权益,是文明执法的重要体现,也是监狱工作法制化、科学化和社会化的重要内容和必然要求,保障罪犯的健康权体现了国家对罪犯基本人权的尊重。但在实践中,罪犯的健康权仍然存在着种种缺损,本文首先肯定罪犯与普通公民享有一样的健康权,以保障罪犯健康权为核心,从完善现有立法的角度出发,论述了罪犯的身体不受侵犯、劳动受保护、医疗救治要及时、保外就医的批准、罪犯的饮食安全与卫生、监狱医院医疗设施要完备这几个方面的问题,以及相应的完善措施,以此更好的保障罪犯的健康权,实现依法治监的要求。
[Abstract]:The right to health, as the due right and legal right of criminals, to safeguard the lawful rights and interests of criminals is an important embodiment of civilized law enforcement, as well as an important content and necessary requirement for the legalization, scientization and socialization of prison work. The protection of criminals' right to health embodies the state's respect for the basic human rights of criminals. However, in practice, there are still various defects in criminals' right to health. Firstly, this paper affirms that criminals and ordinary citizens enjoy the same right to health, taking the protection of criminals' right to health as the core, and starting from the angle of perfecting existing legislation. This paper discusses the problems of the criminal's body inviolability, the protection of labor, the timely medical treatment, the approval of seeking medical treatment outside the prison, the food safety and hygiene of the criminal, the perfection of the medical facilities in the prison hospital, and the corresponding consummation measures. In order to better protect the right to health of criminals, to achieve the requirements of administering prison according to law.
