【摘要】：量刑建议制度是近年来检察机关在公诉改革活动中提出的一个新课题。我国部分省、市检察机关陆续开展了量刑建议改革试点工作,取得了良好的效果。近年来,国内的一些基层检察院也陆续推行量刑建议制度。众多学者对这一热点问题也表现出极大的兴趣,开始对量刑建议制度的相关理论进行研究,并且取得了一定的学术成果。尽管如此,我国量刑建议制度一直未能真正建立起来。本文基于我国司法制度的实际,从确定检察机关这个量刑建议主体出发,分四部分论述我国检察机关量刑建议制度的建立。第一部分主要是概述了量刑建议制度。论述了量刑建议权、量刑建议的主体、量刑建议制度的具体内容,为量刑建议制度的建立提供理论支持。第二部分是对国外量刑建议制度的借鉴。通过对比英美法系和大陆法系的主要国家的相关制度,找出这些国家建立量刑建议制度的有益的经验,为我国建立自己的量刑建议制度提供借鉴。第三部分是提出建立量刑建议制度的意义。从完善公诉职权、加强法律监督和优化刑事诉讼三个方面提出建立量刑建议制度的意义,说明该项制度在我国建立的必要性。第四部分是对我国建立量刑建议制度的构想。从确立量刑建议制度的立法地位、量刑建议配套制度的设立和强化司法工作人员自身素质三个方面提出建议,希望通过这些建议,为我国最终建立量刑建议制度提供现实基础。
[Abstract]:Sentencing suggestion system is a new subject put forward by procuratorial organs in the reform of public prosecution in recent years. Some provincial and municipal procuratorial organs have carried out the trial work of sentencing suggestion reform one after another, and achieved good results. In recent years, some basic procuratorates in China have been carrying out sentencing recommendation system. Many scholars have shown great interest in this hot issue, began to study the relevant theory of sentencing recommendation system, and achieved certain academic results. Nevertheless, our country sentencing suggestion system has not really established. Based on the reality of our judicial system, this paper discusses the establishment of sentencing suggestion system of procuratorial organs in four parts, starting from the determination of procuratorial organ as the subject of sentencing advice. The first part is a summary of sentencing recommendation system. It discusses the right of sentencing suggestion, the subject of sentencing suggestion, the concrete content of sentencing suggestion system, and provides theoretical support for the establishment of sentencing suggestion system. The second part is the reference to the foreign sentencing suggestion system. By comparing the relevant systems of the common law system and the continental law system, this paper finds out the beneficial experience of establishing the sentencing suggestion system in these countries, and provides a reference for our country to establish its own sentencing suggestion system. The third part is the significance of establishing sentencing suggestion system. From three aspects of perfecting the power of public prosecution, strengthening legal supervision and optimizing criminal procedure, the significance of establishing sentencing suggestion system is put forward, and the necessity of establishing this system in our country is explained. The fourth part is the conception of establishing sentencing suggestion system in our country. This paper puts forward some suggestions from three aspects: establishing the legislative status of sentencing suggestion system, establishing the supporting system of sentencing suggestion and strengthening the quality of the judicial staff themselves, hoping to provide a realistic basis for the establishment of the sentencing suggestion system in our country.
