“多片面”环境中的司法独立

【摘要】：司法独立不是封闭的,而是存在于一个开放的、“多片面”的环境中。媒体、舆论、民意……这些“多片面”都是影响司法独立的重要力量。司法机关及其司法人员在司法活动过程中遇到这些“多片面”的“来袭”时往往会感到紧张和不知所措。因此,司法在媒体、舆论、民意等“多片面”环境中如何正确处理与它们之间的关系,有效遏制“多片面”对司法独立的消极影响,充分发挥“多片面”对司法独立的积极影响,从而使司法机关既能遏制司法腐败、司法专横、司法混乱等现象,又能加强司法独立,形成二者的良性互动,是一个值得深入研究的问题。本文采用文献资料法、比较研究法、个案法等研究方法,立足于对影响司法独立的“多片面”环境进行研究,分析“多片面”环境对司法独立的正反面影响,从而对如何正确处理“多片面”与司法独立的关系；遏制“多片面”对司法独立的消极影响,充分发挥“多片面”对司法独立的积极影响；以“多片面”促进司法独立；通过规范与改善影响司法独立的“多片面”环境,完善我国的司法体制、机制促进“多片面”环境中司法独立的实现提出自己的设想与建议。
[Abstract]:Judicial independence is not closed, but exists in an open, multi-sided environment. The media, public opinion, public opinion. These "multi-sided" are important forces that affect the independence of the judiciary. The judiciary and its personnel often feel nervous and overwhelmed when they encounter these "multi-sided" attacks in the course of judicial activities. Therefore, in the media, public opinion, public opinion and other "multi-sided" environment, how to correctly handle the relationship between the judiciary and them, and effectively curb the negative impact of "multi-sided" on the independence of the judiciary, Giving full play to the positive influence of "multi-sided" on judicial independence, so that judicial organs can not only contain judicial corruption, judicial arbitrariness and judicial confusion, but also strengthen judicial independence and form a positive interaction between the two. It is a problem worthy of further study. This paper adopts the methods of literature, comparative study, case study and so on, based on the study of the "multi-sided" environment that affects the judicial independence, and analyzes the positive and negative effects of the "multi-one-sided" environment on the judicial independence. Thus, how to correctly handle the relationship between "multi-sided" and judicial independence, contain the negative influence of "multi-one-sided" on judicial independence, give full play to the positive impact of "multi-one-sided" on judicial independence, and promote judicial independence with "multi-one-sided"; Through standardizing and improving the "multi-one-sided" environment affecting judicial independence, perfecting our judicial system and promoting the realization of judicial independence in "multi-one-sided" environment, the author puts forward his own ideas and suggestions.
