我国巡回审判制度的现状及其完善

【摘要】：巡回审判制度在我国是一项颇具中国特色的制度，它的形成和发展有着浓厚的本土色彩。新中国成立以来，巡回审判制度经历过被重视、被抛弃、又被重新拾起的坎坷命运，目前来说，它已成为我国诉讼制度的重要组成部分，对我国法治建设和构建社会主义和谐社会贡献着力量。现今，恰是巡回审判工作在我国蓬勃开展的大好时代。《民事诉讼法》对巡回审判早有规定，最高人民法院不断出台文件强调巡回审判的作用，各地巡回审判组织如雨后春笋般建立起来，巡回审判制度正在不断发展完善。而与巡回审判相关的一系列问题萦绕在人民耳旁：巡回审判到底是否适合在中国开展？其开展的意义何在？到底巡回审判的发展在我国处于一个什么阶段？我们又如何完善巡回审判制度，，使之在中国发热发光？本文力求寻找出答案。考察巡回审判在我国的形成可知，自广州国民政府到南京国民政府再到共产党领导的红色革命根据地，巡回审判生根发芽成长乃是国情所迫，形势所逼。所以，本文所讨论的巡回审判是我国土生土长的巡回审判，是中国国情下的巡回审判。通过理论分析及大量数据案例的佐证，巡回审判制度巡回审判制度在中国发展有着理论上的可行性和实践上的必然性，我国巡回审判现状得以形成有着深刻的理论及实践基础。我国巡回审判发展的现状是既有理论的探讨，又有相关立法规定，各地对巡回审判也进行了大量的实践。本文对指导我国巡回审判工作最主要和最直接的《最高人民法院关于全面加强人民法庭工作的决定》和《最高人民法院关于大力推广巡回审判方便人民群众诉讼的意见》做了解析，并归纳分析了我国巡回审判在各地的发展情况，对巡回审判的特点进行了总结，并通过案例的形式说明了巡回审判在我国运行的实际状况。巡回审判开展以来，有成效，有不足，总得来说，不足更突显。在此基础上，本文对我国巡回审判制度的完善提出了一些建议。其中包括加强巡回审判开展的适宜性的指导、完善巡回审判规则和程序、加强巡回审判物质保障和降低运行成本以及加强巡回审判组织和人民调解委员会的协作。其中关于完善巡回审判规则和程序、加强巡回审判组织和人民调解委员会的协作中的若干具体构想，是本文力求突破创新的部分。
[Abstract]:Circuit trial system is a system with Chinese characteristics in China, its formation and development has a strong local color. Since the founding of the people's Republic of China, the itinerant trial system has experienced a rough fate that has been attached importance to, abandoned, and picked up again. At present, it has become an important part of our litigation system. It contributes to the construction of the rule of law and the construction of a harmonious socialist society. Now, it is a good time for the circuit trial work to flourish in our country. The "Civil procedure Law" has long stipulated the circuit trial. The Supreme people's Court has constantly issued documents emphasizing the role of the circuit trial. Circuit trial organizations everywhere are springing up like bamboo shoots, circuit trial system is constantly developing and improving. And a series of questions related to the itinerant trials haunt the people's ears: is the itinerant trial suitable for China? What is the significance of its development? What stage is the development of the circuit trial in our country? How can we improve the circuit trial system and make it glow in China? This paper tries to find out the answer. The formation of itinerant trial in China shows that from Guangzhou National Government to Nanjing National Government to the Red Revolutionary Base led by the Communist Party, the roving trial is forced by the national conditions and forced by the situation. Therefore, the circuit trial discussed in this paper is a native circuit trial and a circuit trial under China's national conditions. Through the theoretical analysis and the evidence of a large number of data cases, the development of the circuit trial system in China has theoretical feasibility and practical inevitability, and the present situation of our country's itinerant trial has a profound theoretical and practical foundation. This paper gives guidance to the most important and direct decision of the Supreme people's Court on strengthening the work of the people's Court and the Supreme people's Court on vigorously promoting the Circuit trial to facilitate the people's Litigation The comments were parsed, This paper also summarizes and analyzes the development of the circuit trial in China, summarizes the characteristics of the circuit trial, and explains the actual situation of the circuit trial in our country through the form of cases. Since the launch of the circuit trial, has been effective, there are shortcomings, in general, the shortcomings are more prominent. On this basis, this paper puts forward some suggestions on the perfection of our country's circuit trial system. It includes strengthening the guidance of the suitability of the circuit trial, perfecting the rules and procedures of the circuit trial, strengthening the material guarantee and reducing the operating cost of the circuit trial, and strengthening the coordination between the circuit trial organization and the people's mediation committee. Some concrete ideas about perfecting the rules and procedures of the circuit trial and strengthening the cooperation between the circuit trial organization and the people's mediation committee are the parts of this paper which strive to break through the innovation.
