农村纠纷多元化解机制研究

【摘要】：对农村社会的研究就要深入了解转型社会中的农村纠纷解决的状况,深刻把握农村纠纷的发生、发展以及最终的解决过程,这样的有利于我们认识一个真实的农村纠纷,而本文对农村纠纷解决机制的探索则是对当前农村矛盾的大量涌现和国家推行“大调解”格局下的一次资源整合,通过具体事件的描述还原一个真实的逻辑地发生着的农村纠纷以及纠纷解决的路径,我所做的研究正是在前人的基础上的一次探索,把多元化解机制引入农村纠纷的解决过程,以期对当前农村纠纷的解决有所突破和贡献。 转型背景下探索农村纠纷多元化解机制是我所试图以法社会学的研究方法对农村问题所作的一次尝试,期间我做了大量的调研、访谈和实地考察工作,获得了关于农村纠纷的第一手的资料,虽然资料还不够全面,但是对于研究农村纠纷以及在这些资料中找寻关于农村纠纷解决的方法是一种有益的探索。本文引用的各种统计数据和实证材料基本上可以描述中国社会的纠纷和纠纷解决的框架,但并不能完全和细致地展现其全貌,从这些数据来观察和描述纠纷及其解决是一个好的视角,但也只能是从一个侧面部分地展现纠纷及其解决过程。 本文主要探讨了农村纠纷多元化解机制。第一部分从研究的目的、意义以及国内外的研究现状出发,引出学者们对纠纷的不同观点。第二部分则是对农村纠纷的概述,从农村社会的基本特征、农村纠纷的特点以及农村纠纷的类型来深刻地认识农村纠纷的状况。第三部分则是对农村纠纷的多元化解进行研究,从农村纠纷多元化解选择的影响因素和农村纠纷多元化解的方式来加深对多元化解机制的理解。第四部分则是从国家法与民间法的冲突,诉讼与非诉方式的选择,非诉纠纷解决方式在农村运作的可能性以及现代农村司法介入的必要性四个方面来分析农村纠纷多元化解的二难因境。最后一部分是构建农村纠纷多元化解的路径,提出了建立人民调解机制、行政机构调解机制、法院附设调解机制和律师主导调解机制四种不同的调解机制对农村纠纷化解的影响。
[Abstract]:The study of rural society requires a deep understanding of the situation of rural dispute resolution in a transitional society, and a profound grasp of the occurrence, development and final settlement process of rural disputes, which is conducive to our understanding of a real rural dispute. The exploration of the rural dispute resolution mechanism in this paper is a combination of resources under the pattern of "Great Mediation" and the emergence of a large number of contradictions in the current rural areas. Through the description of specific events to restore a real logically occurring rural disputes and dispute resolution path, my research is based on the previous exploration, the diversification of the solution mechanism into the rural dispute resolution process, With a view to the current rural dispute resolution has a breakthrough and contribution. Under the background of transformation, it is my attempt to explore the diversification mechanism of rural dispute resolution with the research method of sociology of law. During this period, I have done a lot of research, interviews and field work. First hand information on rural disputes has been obtained. Although the information is not comprehensive enough, it is a useful exploration to study rural disputes and find ways to resolve them in these materials. The statistical data and empirical materials cited in this paper can basically describe the framework of disputes and dispute resolution in Chinese society, but they do not give a complete and detailed picture of them. It is a good perspective to observe and describe the dispute and its resolution from these data, but it can only show the dispute and its resolving process from one side. This paper mainly discusses the diversification of rural dispute resolution mechanism. The first part starts from the purpose, significance and current situation of research at home and abroad, leading to different viewpoints of scholars on disputes. The second part is an overview of rural disputes, from the basic characteristics of rural society, the characteristics of rural disputes and types of rural disputes to deeply understand the status of rural disputes. The third part is to study the diversification of rural disputes, from the rural dispute diversification solution choice factors and rural dispute diversification solutions to deepen the understanding of the mechanism of diversification. The fourth part is the conflict between national law and folk law, the choice of litigation and non-litigation. The possibility of non-litigation dispute resolution in rural areas and the necessity of judicial intervention in modern rural areas are discussed in this paper. The last part is to construct the path of multi-resolution of rural disputes, put forward the establishment of the people's mediation mechanism, administrative mediation mechanism, The influence of four different mediation mechanisms on rural dispute resolution: court mediation mechanism and lawyer-led mediation mechanism.
