中国检察机关对刑事审判的法律监督问题研究

【摘要】：中国检察制度的特色,在于宪法对于检察机关法律地位的规定,即“国家的法律监督机关”。这一宪法定位不仅使得法律监督成为中国检察制度的核心,而且也使法律监督制度成为了一种国家政治制度。因此,完善法律监督制度,有效实施法律监督,既是建设中国特色检察制度的重要内容,也是建设国家政治制度,维护宪法和法律统一、完整实施的迫切需要。然而,当前我国检察机关的法律监督现状却与检察理论界和实务界一直以来强调加强法律监督的强烈诉求相差甚远。特别是检察机关对刑事审判的法律监督现状,更是毫不掩饰地反映出了法律监督在理论上的偏颇和在实践中的无奈,对刑事审判的法律监督也早已成为众多学者前赴后继研究法律监督理论、探索法律监督实践的理想领域。本文分三个部分对检察机关的刑事审判法律监督问题进行探讨。第一部分是对我国刑事审判法律监督在立法、理论、实践三个方面现状的介绍,以及由现状所反映问题的阐明和剖析,以期找到我国刑事审判法律监督制度的症结所在,为加强和完善刑事审判阶段的法律监督打下基础、明确方向。第二部分是对当前刑事审判法律监督理论和实践所引发质疑的阐述和回应,通过对刑事审判法律监督与审判独立、控辩平等之间关系的厘清,以及对“谁来监督监督者”这一问题的回答,以期为刑事审判阶段法律监督工作的改革完善,扫清思想障碍,减少观念阻力。第三部分是在前两部分的基础上,对我国刑事审判法律监督制度在理论、立法方面的寥寥思考,以及在实践改革方面的一己拙见,以期有益于我国刑事审判的法律监督工作,而不至贻笑大方。
[Abstract]:The characteristic of China's procuratorial system lies in the constitutional regulation on the legal status of procuratorial organs, that is, the state's legal supervisory organs. This constitutional orientation not only makes legal supervision the core of China's procuratorial system, but also makes the legal supervision system a national political system. Therefore, perfecting the legal supervision system and carrying out the legal supervision effectively are not only the important contents of constructing the procuratorial system with Chinese characteristics, but also the urgent need of building the national political system, maintaining the unity of the constitution and law, and implementing the law completely. However, the current situation of legal supervision of procuratorial organs in our country is far from the strong demand of strengthening legal supervision in procuratorial theorists and practitioners. In particular, the present situation of the procuratorial organs' legal supervision over criminal trials is an undisguised reflection of the theoretical bias and the helplessness of legal supervision in practice. The legal supervision of criminal trial has already become an ideal field for many scholars to study the theory of legal supervision and explore the practice of legal supervision. This article divides into three parts to the procuratorial organ's criminal trial legal supervision question carries on the discussion. The first part is the introduction of the present situation in the legislative, theoretical and practical aspects of the legal supervision of criminal justice in our country, as well as the clarification and analysis of the problems reflected by the present situation, in order to find out the crux of the legal supervision system of the criminal trial in our country. In order to strengthen and improve the legal supervision of the criminal trial stage lay the foundation, clear direction. The second part is the elaboration and response to the challenge caused by the current theory and practice of the legal supervision of criminal trial, through the clarification of the relationship between the legal supervision of the criminal trial and the independence of the trial, and the equality of prosecution and defense. And the answer to the question of "who will supervise" in order to improve the reform of the legal supervision in the criminal trial stage, clear up the ideological obstacles and reduce the idea resistance. The third part is on the basis of the first two parts, on the basis of our criminal trial legal supervision system in theory, legislation, as well as in the practice of a humble view of reform, in order to benefit our legal supervision of criminal justice. And not to laugh.
