西藏青少年服刑人员教育改造问题研究

【摘要】:近年来,青少年犯罪业已成为一个受到全世界高度关注的问题。青少年能否健康成长,事关一国可持续发展大局。在我国,这一问题的解决也刻不容缓。但是我国幅员辽阔,东、中、西部地区的社会经济文化等方面差异大,导致青少年犯罪相关问题在我国不同地区的特点亦有不同。因此,本着具体问题具体对待的原则,对西藏青少年服刑人员的教育改造问题进行专项研究显得尤为必要。目前,就如何提高对青少年的教育改造质量,专家、学者以及热心于青少年服刑人员教育矫治工作的人提出了很多有见解的方法,但是,本文的难点在于,专门研究西藏青少年服刑人员教育改造问题的相关资料极度缺乏,研究者甚少,部分文献对此问题只是浅尝辄止式的论述。本文将主要研究西藏青少年服刑人员的教育改造问题。这是一项系统工程,需要从方方面面进行论证考虑:文章首先界定明晰了“者少年”的年龄界限,以便确定研究对象范围,进行有针对性的研究;通过问卷调查、个案访谈、案例分析和文献研究等方法,厘清藏区青少年犯罪的主要类型,分析其犯罪的六个主要特点和诱使青少年犯罪的各种因素,以便掌握犯罪规律,进而为预防藏区青少年犯罪提供理论支持;深入藏区监狱内部,了解青少年在狱中的表现并深刻分析其深层次原因,对现行青少年服刑人员教育改造工作成效进行评估,以便发扬优点,改进不足。创新之处在于,笔者通过大量实践调查,收集并掌握了较为丰富的第一手资料,结合当下一些在相关领域较为成熟、新颖的教育矫治理论,提出自己对预防青少年犯罪以及对在押服刑青少年罪犯的教育改造问题的看法:在现有法律、法规框架体系内,做好狱内“三期”工作,认真实施对罪犯的分类处遇以及刑罚执行的“过渡性”原则,全面普及并加强对罪犯进行“心理矫治”,使这一制度真正落到实处,同时要建立健全社区矫治体系,使对青少年罪犯的教育改造形成一条龙式的、常态化的机制。当然,传统的研究,比如从青少年自身、社会经济政治文化、教育机构(学校为主)、家庭和国家等方面入手来预防青少年犯罪以及对犯罪青少年的教育改造,也是本文必不可少的一部分。期待本文可以为藏区青少年服刑人员的教育改造问题提供一些有益的参考。
[Abstract]:In recent years, juvenile delinquency has become a problem of great concern all over the world. Whether young people can grow healthily is related to the overall situation of a country's sustainable development. In our country, the solution of this problem is also urgent. However, there are great differences in social economy and culture in the east, middle and west regions of our country, which leads to different characteristics of juvenile delinquency in different regions of our country. Therefore, in line with the principle of concrete treatment, it is particularly necessary to study the educational reform of Tibetan juvenile prisoners. At present, many insightful methods have been put forward on how to improve the quality of education and reform of teenagers, experts, scholars and people who are enthusiastic about the education and correction of juvenile prisoners. However, the difficulty of this paper lies in: The research on the education and reform of Tibetan juvenile prisoners is extremely short of relevant information, and few researchers, some literature on this issue is only a bit of discussion. This paper will mainly study the educational reform of Tibetan juvenile prisoners. This is a systematic project, which needs to be demonstrated and considered from all aspects: firstly, the article defines and defines the age limit of "the juvenile of the person", in order to determine the scope of the study object, carry on the targeted research; through the questionnaire survey, the case interview, By means of case analysis and literature study, the paper clarifies the main types of juvenile delinquency in Tibetan areas, analyzes the six main characteristics of the crime and the various factors that induce juvenile delinquency, in order to grasp the law of crime. To provide theoretical support for the prevention of juvenile delinquency in Tibetan areas, to go deep into the prisons in Tibet, to understand the performance of young people in prison and to analyze their deep-seated causes, and to evaluate the effectiveness of the education and reform work of the current juvenile prisoners. In order to carry forward the advantages, improve the shortcomings. The innovation lies in the fact that through a large number of practical investigations, the author has collected and grasped more abundant first-hand information, combined with some relatively mature and novel educational correction theories in relevant fields at present. Put forward their own views on the prevention of juvenile delinquency and the education and reform of juvenile offenders in prison: do a good job of "three periods" in prison within the framework of existing laws and regulations, Conscientiously implementing the principle of "transitional" in the classification of criminals and the enforcement of penalties, and comprehensively popularizing and strengthening the "psychological correction" of criminals, so that this system can really be put into practice, and at the same time establishing and improving the community correction system, To make the education and reform of juvenile criminals into a one-stop, regular mechanism. Of course, traditional studies, such as the prevention of juvenile delinquency and the educational reform of juvenile delinquents from the aspects of youth themselves, social, economic, political, cultural, educational institutions (mainly schools), families and countries, It is also an essential part of this paper. It is expected that this paper can provide some useful reference for the educational reform of juvenile prisoners in Tibetan area.
