论律师执业中的利益冲突

【摘要】：律师执业中的利益冲突是个非常普遍的问题，而且在实践中极其复杂，在各国律师界都很棘手。律师执业中的利益冲突不仅关系到委托人的利益，还涉及到律师业的健康发展以及整个司法系统的健全。因此如何辨别利益冲突并合理缓解显得格外重要。本文按照律师-委托人发展关系的进程，将各个阶段律师执业中的利益冲突分为：单一委托关系中的利益冲突，双重委托关系中的利益冲突，前后委托案件利益冲突，并对风险代理中的利益冲突以及当事人利益与公共利益冲突这两个非常典型的利益冲突具体分析。本文将每一类利益冲突单独成章，详细分析利益冲突的产生形式，以及利益损害分析，并结合美国和我国对此问题的相关规定，，分析各自规定的利弊，并对我国利益冲突立法完善提出一些自己见解，希望对律师执业中利益冲突的解决有所贡献。
[Abstract]:Conflict of interest in the practice of lawyers is a very common problem, and in practice is extremely complex, lawyers in the world is very difficult. The conflict of interest in the practice of lawyers is not only related to the interests of clients, but also to the healthy development of the legal profession and the integrity of the entire judicial system. Therefore, how to distinguish conflicts of interest and reasonable mitigation is particularly important. According to the process of developing the relationship between lawyer and client, this paper divides the conflict of interest in the practice of lawyer into three categories: the conflict of interest in the single entrustment relationship, the conflict of interest in the double entrustment relationship, and the conflict of interest in the entrustment case. The conflict of interest in risk agency and the conflict of interest between the parties and the public interest are analyzed in detail. This paper makes a separate chapter on each kind of conflicts of interest, analyzes in detail the form of conflict of interest and the analysis of interest damage, and analyzes the advantages and disadvantages of the respective provisions in combination with the relevant provisions of the United States and China on this issue. It also puts forward some opinions on the perfection of our country's conflict of interest legislation, hoping to contribute to the solution of the conflict of interest in the practice of lawyers.
