法律职业伦理：司法改革的深层支撑

【摘要】：法律职业伦理是法学理论和实践的重要课题,它既是法律机制运行必不可少的价值支撑,又是法律从业者必须遵守的职业道德底线,因而,构成了抵御司法腐败的重要防线和维护司法公正的根本保障。由于多种复杂因素的制约、以及中国法治发展的特殊进路的影响,致使我国法律职业伦理处于严重缺失状态,而且在法学教育中也没有引起足够的重视,这无疑成为加剧司法腐败、影响司法公正的重要原因之一。同时,也在一定程度上导致中国的司法改革只能在外显层面进行,而难以深入到内在机制和文化价值,从而难免出现“现代制度下的传统人”、以及“新瓶装旧酒”的内在张力和扭曲。本文对法律职业伦理的缺失现状及其对司法改革的严重影响进行了深刻的剖析,对相应的解决措施提出了自己的见地,通过大力加强法律职业伦理建设,促进司法改革由表层向纵深发展和完善,推动法治国家的早日建立。
[Abstract]:Legal professional ethics is an important subject in the theory and practice of law. It is not only the essential value support of the operation of legal mechanism, but also the bottom line of professional ethics that legal practitioners must abide by. It constitutes an important defense against judicial corruption and a fundamental guarantee to maintain judicial justice. Because of the restriction of many kinds of complex factors and the influence of the special way of the development of the rule of law in China, the legal professional ethics in our country is in a serious lack of state, and it has not aroused enough attention in the law education. This undoubtedly becomes one of the important reasons that aggravate the judicial corruption and affect the judicial justice. At the same time, to a certain extent, the judicial reform in China can only be carried out on the explicit level, but it is difficult to penetrate into the intrinsic mechanism and cultural value, thus "traditional people under the modern system" inevitably appear. And the inner tension and distortion of old wine in new bottles. This paper makes a profound analysis of the lack of legal professional ethics and its serious influence on the judicial reform, and puts forward its own views on the corresponding solutions, through strengthening the construction of legal professional ethics. To promote the judicial reform from the surface to the depth of development and improvement, to promote the early establishment of a country ruled by law.
