人民监督员制度探析

【摘要】：人民监督员制度是司法体制的一项创新,依据民主法治的政治原则设立。人民监督员制度作为社会监督的独立一环,对人民检察院正确行使自侦案件侦查权有着不可或缺的监督和制约作用。经过近十年的试验与推广,人民监督员制度的重要意义以及程序运行过程中的一些问题也逐渐的显现出来。借此契机,本文就人民监督制度的基本内容以及运行过程中出现的争议进行较为详细的论述,以期能够加强人民监督员对检察院自侦案件的制约作用,更好地推进我国司法建设的进程。
[Abstract]:The system of people's supervisors is an innovation of the judicial system, which is based on the political principles of democracy and rule of law. As an independent part of social supervision, the system of people's supervisors plays an indispensable role in supervising and restricting the people's procuratorate's correct exercise of the right to investigate self-investigating cases. After nearly ten years of experiments and popularization, the importance of the system of people's supervisors and some problems in the process of program operation also gradually appeared. Taking this opportunity, this paper discusses in detail the basic contents of the people's supervision system and the disputes arising in the course of operation, with a view to strengthening the restrictive role of the people's supervisors on the self-investigating cases of the procuratorate. Better promote the process of judicial construction in our country.
