论国家治理视角下我国多元化纠纷解决机制建设

【摘要】：纠纷解决机制的成熟和完备,是国家治理体系和治理能力现代化的基本标志,在国家治理体系中居于核心地位。最高人民法院从2004年起牵头开展了"多元化纠纷解决机制改革",是国家治理体系和治理能力现代化的一个重要尝试。本文回顾了我国"多元化纠纷解决机制改革"项目推进的10年历程,认为多元化纠纷解决机制改革实践丰富和发展了国家治理理论,发展了关于法院的"规则之治"和"化解纠纷"功能的司法理论。未来在"国家制定发展战略、司法发挥保障作用、推动国家立法进程"的新三步战略的整体部署下,实现国家治理体系和治理能力现代化对多元化纠纷解决机制的6个新要求,最终建立系统完备、科学规范、运行有效的纠纷解决制度体系。
[Abstract]:The maturity and perfection of the dispute settlement mechanism is the basic symbol of the modernization of the national governance system and governance capacity, and occupies the core position in the national governance system. Since 2004, the Supreme people's Court has led the reform of the pluralistic dispute resolution mechanism, which is an important attempt to modernize the national governance system and governance capacity. This paper reviews the 10-year progress of the project "Reform of pluralistic dispute Resolution Mechanism" in China, and points out that the practice of the Reform of pluralistic dispute Resolution Mechanism enriches and develops the theory of national governance. The judicial theory about the function of "rule of law" and "resolving disputes" has been developed. In the future, under the overall deployment of the new three-step strategy of "the State formulates a development strategy, plays a safeguard role, and promotes the national legislative process," the modernization of the national governance system and governance capacity will bring about six new requirements for a pluralistic dispute resolution mechanism. Finally establish a complete system, scientific norms, and run an effective dispute resolution system.
