网络民意表达与司法独立关系之研究

【摘要】：网络民意表达是一种新的社会现象,它是随着网络的发展而产生的。与传统的民意表达相比网络民意表达表现出许多不同之处,如缺乏有效地监管、运行机制不同于传统民意表达、网络民意表达更具时效性、具有很强的随意性、容易快速形成合力、范围更广等等,它对司法独立也将产生巨大的影响。本文主要从网络民意表达的产生、网络民意表达对司法独立的影响、网络民意表达与司法独立关系的合理定位、协调网络民意表达与司法独立关系的制度构建四个部分入手,旨在对网络民意表达影响司法独立的现象做出合理的解释,寻求能够协调二者关系的制度构建,从而改良我国长期被网络民意干预的司法环境。第一章“网络民意表达概述”分为三节。第一节“网络民意表达的产生”主要是从网络民意表达这一新生事物入手,界定了网络民意表达的定义。第二节“网络民意表达与普通民意表达的差别”通过对比网络民意表达与普通民意表达的特征,进一步介绍网络民意表达。第三节“网络民意表达的社会效应”通过正反两方面分析了网络民意表达对社会各界的影响后果。第二章“网络民意表达对司法独立的影响”分为三节。第一节“网络民意表达影响司法独立的表现”通过正反两方面来展开阐述,具体说明了网络民意表达对司法独立的监督作用和消极影响作用。第二节“网络民意表达影响司法独立的实证分析”主要通过三个现实案例来分析网络民意表达如何影响司法独立。第三节“网络民意表达影响司法独立的原因和途径”主要从原因和途径两个方面向深层次分析网络民意表达影响司法独立这一现象。第三章“网络民意表达与司法独立关系的合理定位”分为两节。第一节“网络民意表达和司法独立的价值冲突”主要通过分别分析网络民意表达和司法独立的价值追求,从而得出二者在价值追求上的冲突。第二节“网络民意表达与司法独立关系的理想定位模式”通过分析两种已有的司法模式的缺陷,得出了二者理想的定位模式,即适度封闭和沟通的司法模式。第四章“协调网络民意表达与司法独立关系的制度构建”分为七节。每一节列出了一种制度构建框架,包括建立新闻发言人制度、建立科学的民意沟通表达机制、完善人民陪审制度、加强网络的机关机制、严格法官准入制度、借鉴“专家咨询制度”和“法庭之友”、规范判决书说理制度等等。
[Abstract]:Network public opinion expression is a new social phenomenon, it is with the development of the network. Compared with the traditional public opinion expression, the network public opinion expression shows many differences, such as the lack of effective supervision, the operating mechanism is different from the traditional public opinion expression, the network public opinion expression is more timely and has very strong arbitrariness. It is easy to form force quickly, wider scope, and so on, it will also have a great impact on the independence of the judiciary. This article mainly from the network public opinion expression emergence, the network public opinion expression to the judicial independence influence, the network public opinion expression and the judicial independence relations reasonable orientation, coordinates the network public opinion expression and the judicial independence system construction four parts, The purpose of this paper is to make a reasonable explanation of the influence of network public opinion expression on judicial independence and to seek a system that can coordinate the relationship between them so as to improve the judicial environment which has been interfered by network public opinion for a long time in our country. The first chapter "Network Public opinion expression Summary" is divided into three sections. The first section "the emergence of the network public opinion expression" mainly from the network public opinion expression this new thing, has defined the network public opinion expression definition. The second section, "the difference between network public opinion expression and common public opinion expression", further introduces the network public opinion expression by comparing the characteristics of network public opinion expression and common public opinion expression. The third section "the social effect of the network public opinion expression" through the positive and negative two aspects analyzes the network public opinion expression to the society all walks of life influence the consequence. The second chapter "the influence of network public opinion expression on judicial independence" is divided into three sections. The first section "the expression of network public opinion affects the performance of judicial independence" through both positive and negative aspects, specifically explains the network of public opinion expression on judicial independence supervision and negative impact role. The second section "the empirical analysis of the influence of network public opinion expression on judicial independence" mainly through three practical cases to analyze how the network public opinion expression affects judicial independence. The third section, "the reasons and ways of the influence of network public opinion expression on judicial independence", analyzes the phenomenon of the influence of network public opinion expression on judicial independence from two aspects: one is the reason and the other is the other. The third chapter is divided into two sections: the reasonable orientation of the relationship between network public opinion expression and judicial independence. The first section, "the value conflict between network public opinion expression and judicial independence", mainly analyzes the value pursuit of network public opinion expression and judicial independence respectively, so as to draw a conclusion of the conflict between the two in the pursuit of value. The second section, "the ideal positioning mode of the relationship between network public opinion expression and judicial independence", through analyzing the defects of two existing judicial models, obtains the ideal positioning mode of the two models, that is, the judicial mode of moderate closure and communication. The fourth chapter is divided into seven sections: coordinating the relationship between network public opinion expression and judicial independence. Each section sets out a framework for the construction of the system, including the establishment of a press spokesman system, the establishment of a scientific public opinion communication and expression mechanism, the improvement of the people's jury system, the strengthening of the institutional mechanism of the network, and the strict system of access to judges. Draw lessons from "expert consultation system" and "amicus curiae", standardize judgment reasoning system and so on.
