职务犯罪侦防一体化工作机制研究

【摘要】：职务犯罪侦防一体化是在我国检察机关工作思路的不断转变和历史演进中，逐步产生、发展与完善的。它要求检察机关的预防部门与反贪、反渎部门（统称侦查部门）应当立足于惩治和预防职务犯罪的工作职能，增强职务犯罪侦查工作与预防工作的有机配合、相互渗透，实现信息的有效共享和资源的优化配置。从根本上说，侦防一体化工作机制是要强化侦查和预防两部门的契合程度，以侦带防、以防促侦，使侦查与预防两项工作相得益彰，最终强化职务犯罪惩治与预防的整体效能和综合效果。侦防一体化工作机制作为增强职务犯罪惩治和预防工作的有力举措，在实践中的作用日益凸显。然而，由于相关基础理论研究的薄弱以及缺乏统一的领导和部署，目前侦防一体化尚未形成一套稳定的、长效性的工作机制，，自然也就难以实现其应有的整体效能和社会效果。为此，本文以侦防一体化的理论研究和实践探索为支撑、以侦防一体化具体工作机制的建立和完善为重心、以侦防一体化工作机制的实现路径为补充来展开文章具体内容的论述。本论文共五章。第一章主要是对侦防一体化的历史背景、基本内涵及主要特征等基本问题进行了梳理和概述，并提出侦防一体化应以实现人力资源的良性互动和信息资源的充分共享为关键点和着力点。第二章力求探寻侦防一体化的理论基础，对系统论的优化组合原则、管理职能的实现机理以及案件侦查的快速反应机制和预防犯罪的综合理念等做了较为详细的探究。第三章着重从实证层面对深圳盐田、菏泽牡丹、北京西城、上海地区等四地的侦防一体化工作模式进行了剖析，挖掘出当前侦防一体化工作的有益探索及面临的主要困境；并对境外几个国家或地区应对职务犯罪工作的实践进行了考察，其在反腐机构设置、规范权力行使及注重保障机制建设与完善等方面的有益经验，值得我国学习和借鉴。第四章作为文章的重心，首先对侦防一体化工作机制建设的必要性和正当性及其所应坚持的法治理念、创新理念、综合治理理念进行了阐述；其次重点提出了侦防一体化具体工作机制的建立和完善设想，主要包括组织领导及职责、信息交流与共享、重要线索通报和移送、会诊研判和争议解决、共同调查与专项预防、绩效考评、定期调研和效果评估以及保密制度等八个方面。最后一章主要指出侦防一体化工作机制的实现路径,即应以法制保障为根本，能力素质作支撑，信息平台为后盾。
[Abstract]:The integration of investigation and prevention of duty crimes is gradually produced, developed and perfected in the continuous change and historical evolution of the working ideas of procuratorial organs in our country. It requires that the prevention department of the procuratorial organ and the anti-corruption department (collectively the investigation department) should base on the function of punishing and preventing the duty crime, strengthen the organic cooperation between the investigation work of the duty crime and the prevention work, permeate each other, and realize the effective sharing of information and the optimal allocation of resources. Fundamentally speaking, the integrated work mechanism of investigation and prevention is to strengthen the degree of agreement between investigation and prevention, in order to detect and promote investigation, to make the investigation and prevention work complement each other, and finally to strengthen the overall effectiveness and comprehensive effect of punishment and prevention of duty crimes. As a powerful measure to strengthen the punishment and prevention of duty crimes, the integrated mechanism of investigation and prevention plays an increasingly prominent role in practice. However, due to the weakness of the relevant basic theory research and the lack of unified leadership and deployment, at present, the integration of investigation and defense has not yet formed a set of stable and long-term working mechanism, so it is naturally difficult to achieve its due overall effectiveness and social effect. Therefore, this paper is supported by the theoretical research and practical exploration of the integration of investigation and prevention, focuses on the establishment and perfection of the specific working mechanism of the integration of investigation and prevention, and complements the realization path of the integration mechanism of investigation and prevention. This paper consists of five chapters. The first chapter mainly combs and summarizes the historical background, basic connotation and main characteristics of the integration of investigation and defense, and puts forward that the integration of investigation and prevention should focus on the realization of benign interaction of human resources and the full sharing of information resources. The second chapter tries to explore the theoretical basis of the integration of investigation and prevention, and probes into the principle of optimal combination of system theory, the realization mechanism of management function, the rapid response mechanism of case investigation and the comprehensive concept of crime prevention. The third chapter analyzes the integration of investigation and defense in Shenzhen Yantian, Heze peony, Beijing Xicheng, Shanghai and other four places from the empirical level, and excavates the beneficial exploration and the main difficulties faced by the current investigation and defense integration work. This paper also investigates the practice of duty crime in several foreign countries or regions, and its beneficial experience in setting up anti-corruption institutions, standardizing the exercise of power and paying attention to the construction and perfection of guarantee mechanism is worthy of our country's study and reference. The fourth chapter, as the focus of the article, first expounds the necessity and legitimacy of the construction of the integrated work mechanism of investigation and defense and the concept of rule of law, innovation and comprehensive governance that should be adhered to. Secondly, it puts forward the idea of establishing and perfecting the specific working mechanism of the integration of investigation and prevention, including eight aspects: organizational leadership and responsibility, information exchange and sharing, important clue notification and transfer, consultation, research and dispute resolution, joint investigation and special prevention, performance evaluation, regular investigation and effect evaluation, and confidentiality system. The last chapter mainly points out the realization path of the integrated work mechanism of investigation and defense, that is, it should be based on the legal guarantee, supported by the ability and quality, and backed by the information platform.
