【摘要】： 本文旨在通过对法律术语的整体梳理,根据方法论的指导,综合运用法学和语言学的研究方法,分析法律术语的特点、趋势、现存问题及相关解决方法。本文以我国(不包括港澳台地区)的法律术语为研究对象,对我国法律术语的特点进行全面的分析和研究。本文在研究方法上有所着重,在运用法律思维研究法律术语的基础上,结合语料库软件,以笔者收录建立的法律术语数据库为研究对象,做全方位测查。在具体建立法律术语数据库时,笔者以国内当前现行有效的基本法律为基础,运用语料库软件收录词语,并且结合法律术语的结构特点纠正软件测查的错误之处,另外参照我国现有的各种法律辞典,确定了本文所要研究的法律术语数据库。在具体研究时,本文首先对法律术语的概念做了细致的限定。其次,通过语料库软件的检索、收集,从法律术语的数量和比例等方面,以实际数据为支撑,对法律术语的特点进行研究。这是本文的研究重点,对法律术语的特点从语法、语义、功能以及构词分布四个方面分析,提出了自己的见解。第三,根据对法律术语的概念的确定、法律术语与其他词语区别的具体界定、法律术语的特点等研究方面,再以《民法通则》、《合同法》、《公司法》和《物权法》为例,分析法律术语的发展趋势。通过具体分析,笔者认为法律术语具有针对性、“法律效力化”、合理化、符合本民族语言习惯化和“词组化”的趋势。最后,通过语料库软件对法律术语的整体测查、分析,提出我国现阶段法律术语使用过程中存在的一些问题。并且,针对法律术语现存的问题,提出相应的解决方法。
[Abstract]:The purpose of this paper is to analyze the characteristics and trends of legal terms according to the guidance of methodology and the research methods of law and linguistics. This paper takes the legal terms of our country (excluding Hong Kong, Macao and Taiwan) as the research object, and makes a comprehensive analysis and research on the characteristics of the legal terms in our country. This paper focuses on the research methods, on the basis of the use of legal thinking to study legal terms, combined with the corpus software, the author included the establishment of the legal terminology database as the research object. In the specific establishment of the legal terminology database, the author based on the current effective basic laws in China, using corpus software to include words. Combining with the structural characteristics of legal terms to correct the errors in software testing and checking, and referring to the existing legal dictionaries in China, the database of legal terminology to be studied in this paper is determined. In the specific study, this paper first of all the concept of legal terms to make a detailed definition. Secondly, through the corpus-based software retrieval, collection, from the number and proportion of legal terms and other aspects, with the support of actual data, the characteristics of legal terms are studied. This is the focus of this paper. This paper analyzes the characteristics of legal terms from four aspects: grammar, semantics, function and word formation distribution. Third, according to the definition of the concept of legal terms, the specific definition of legal terms and other words, the characteristics of legal terms and other aspects of research, and then with "General principles of Civil Law", "contract Law". "Company Law" and "Real right Law" are examples to analyze the development trend of legal terms. Through specific analysis, the author thinks that legal terms have pertinence, "legal effect", and rationalization. In line with the national language habituation and "phrase" trend. Finally, through the corpus software to the legal terminology overall survey, the analysis, proposed our country present stage legal term use process existence question, moreover, aimed at the legal term extant question. The corresponding solutions are put forward.
